【摘要】：正引言由于我國與美國在國家結構、法院結構上均存在重大差別,導致兩國的管轄權制度存在重大差別。我國學術界對美國的管轄權制度的研究相對于其他制度,如發(fā)現(xiàn)程序、證據(jù)制度而言,差距甚遠。原因也許是我國學者覺得美國的管轄權制度對我國的管轄權制度借鑒意義不大。事實并非如此。不僅美國管轄制度中的程序正義思想對于我國管轄權
[Abstract]:It is pointed out that there are significant differences in the court structure between China and the United States, which leads to significant differences in the jurisdiction system between the two countries. Compared with other systems, such as discovery procedure and evidence system, the research on American jurisdiction system in Chinese academic circles is far from that of other institutions. The reason may be that Chinese scholars think that the American jurisdiction system is of little significance to our jurisdiction system. This is not the case.
