【摘要】：清末以來,列強(qiáng)環(huán)伺、內(nèi)亂綿延。為實(shí)現(xiàn)民族獨(dú)立和國家統(tǒng)一,清政府和民國政府積極進(jìn)行保密法制建設(shè),建立電報(bào)保密制度、軍事秘密保護(hù)制度和新聞保密審查制度,頒布刑法典,懲治泄漏國家秘密犯罪。保密法制的建立和發(fā)展為抗戰(zhàn)中的保密工作奠定了良好的制度基礎(chǔ)。但中國近代保密法制未能完全實(shí)現(xiàn)其立法目的。袁世凱時(shí)期甚至以保密為名迫害新聞媒體,造成新聞業(yè)的重大衰退。國民政府保密法制也有過于嚴(yán)厲之處。這給保密法制的發(fā)展蒙上陰影。如何妥善處理國家保密權(quán)與新聞自由以及公開的關(guān)系,是中國近代保密法制未能完全解決的一大難題。
[Abstract]:Since the end of the Qing Dynasty, the great powers have surrounded themselves, and civil strife has continued. In order to realize the national independence and national unity, the Qing government and the Republic of China government actively carried out the construction of the secrecy legal system, established the telegram secrecy system, the military secret protection system and the news secrecy examination system, promulgated the criminal code, punished the crime of leaking the state secret. The establishment and development of the secrecy system laid a good institutional foundation for the secrecy work in the War of Resistance against Japan. However, China's modern secrecy law failed to fully achieve its legislative purpose. Yuan Shikai even persecuted the news media in the name of secrecy, causing a major decline in journalism. The national government's secrecy laws are also too strict. This casts a shadow over the development of the secrecy system. How to properly deal with the relationship between the right of state secrecy and the freedom of the press as well as the openness is a major problem which has not been completely solved by the Chinese modern secrecy law.
