【摘要】：中國(guó)社會(huì)存在多元的權(quán)力體系和法律體系,在國(guó)家法之外還存在著大量的民間契約。它以一種非國(guó)家強(qiáng)制力的手段作用于特定群體,約束群體內(nèi)個(gè)人的行動(dòng)和人與人之間的關(guān)系。與國(guó)家法相比,這種非官方的契約性民間法根治于特定的群體生活中,最能夠體現(xiàn)群體內(nèi)人們的傳統(tǒng)和生活習(xí)慣,它在某一群體或某一地域內(nèi)所表現(xiàn)出的約束力甚至強(qiáng)于國(guó)家法。中國(guó)的民間契約大多存在于家族制度、神權(quán)觀念、民間性組織制定的規(guī)范、風(fēng)俗習(xí)慣等多種淵源之中。它調(diào)整的事務(wù)涉及婚姻、繼承、買賣、抵押、借貸等諸多內(nèi)容。近現(xiàn)代的社會(huì)發(fā)展造成了已經(jīng)發(fā)展比較完善的民間契約的嚴(yán)重破壞。進(jìn)入現(xiàn)在社會(huì)后,民間契約大量缺失。立足于當(dāng)代法治社會(huì),在構(gòu)建社會(huì)主義和諧社會(huì)和法治社會(huì)的大背景下,重塑和發(fā)展民間契約有現(xiàn)實(shí)意義。發(fā)展民間契約的途徑包括公開的以一般性條款進(jìn)行立法接納、國(guó)家法對(duì)民間法中的具體制度予以吸收、行政與司法機(jī)關(guān)的暗中妥協(xié)、當(dāng)事人的自愿選擇以及默許等方式。
[Abstract]:There are pluralistic power systems and legal systems in Chinese society, and a large number of folk contracts exist in addition to the state law. It acts on a particular group by a non-state coercive force, constraining the actions of individuals within the group and the relationships between people. Compared with the national law, the unofficial contractual folk law can be used to cure the specific group life, and it can best reflect the tradition and living habits of the people in the group. It is more binding in a group or territory than in national law. Most of the folk contracts in China exist in the family system, theocracy, norms made by folk organizations, customs and customs, and so on. It regulates matters such as marriage, inheritance, buying and selling, mortgage, borrowing and so on. The social development of modern times has caused the serious destruction of the relatively perfect folk contract. After entering the present society, a large number of folk contracts are missing. Under the background of constructing socialist harmonious society and ruling by law society, it is of practical significance to reshape and develop folk contract. The ways to develop the folk contract include the public acceptance of legislation with general terms, the absorption of the specific system in the folk law by the state law, the secret compromise between the administrative and judicial organs, the voluntary choice of the parties and the acquiescence of the parties.
