【摘要】：根據(jù)《刑法修正案（八）》的規(guī)定：“在道路上醉酒駕駛機動車的，處拘役，并處罰金，”醉駕開始成為一種犯罪行為。醉駕入罪起到了很好的威懾作用，，不僅受到了大多數(shù)人的歡迎，而且同時也使酒駕和醉駕數(shù)量大幅度下降。由于醉駕在美國是一種較為常見的犯罪行為，而且美國醉駕入罪已有相當(dāng)長的歷史，有著較為完整的法律制度，因此本文首先分析了美國醉駕三級入罪標(biāo)準(zhǔn)（普通標(biāo)準(zhǔn)、青少年標(biāo)準(zhǔn)和職業(yè)司機標(biāo)準(zhǔn)）、酒精測試以及醉態(tài)處理，其中醉態(tài)處理包括了酒精引起的醉態(tài)處理與非酒精引起的醉態(tài)處理。最后在對我國醉駕入罪分析的基礎(chǔ)上，提出對我國醉駕法律制度改進的一些建議，從我國醉駕的入罪標(biāo)準(zhǔn)、醉駕“累犯”、“非醉”下的醉駕入罪以及“毒駕”入罪等方面進行了探討。
[Abstract]:According to the provisions of the Criminal Law Amendment (8): "drunken driving on the road motor vehicle shall be sentenced to criminal detention, and fined," drunk driving began to become a criminal act. Drunk driving serves as a good deterrent, not only popular with most people, but also reducing the number of drunk driving and drunk driving. Since drunk driving is a common crime in the United States, and the United States has a long history of drunk driving, there is a relatively complete legal system. "Adolescent and professional driver standards), alcohol testing, and drunken treatment, which includes alcohol-induced intoxication and non-alcohol-induced intoxication. Finally, on the basis of the analysis of the crime of drunk driving in our country, some suggestions are put forward to improve the legal system of drunk driving in our country, and from the standard of criminalizing drunk driving in our country, "recidivist" of drunk driving is put forward. This paper discusses the crime of drunk driving and the crime of drug driving under non-intoxication.
