遠程公路建設(shè)再融資模式研究:從德國法律視角的考察

【摘要】：遠程公路的建設(shè)和運營因為需要大量的資金,使囊中日趨羞澀的公共部門不得不尋求與私人部門的合作,作為一種新型的制度安排,公私合作制開始在交通基礎(chǔ)設(shè)施領(lǐng)域漸成潮流。為了掃除在該領(lǐng)域內(nèi)的法律障礙,德國政府通過《公私合作制促進法》對遠程公路建設(shè)私人融資作出了新的規(guī)定。在再融資的問題上,私人部門開始擁有了收費模式和酬金模式的選擇權(quán)。文章從法律的視角,探討了相關(guān)問題的立法背景和實踐操作,就兩種模式的優(yōu)缺點進行了分析比較,并得出酬金模式更有利于運營者的初步結(jié)論。
[Abstract]:The construction and operation of long-distance roads, which require a great deal of money, have forced the increasingly shy public sector to seek cooperation with the private sector as a new type of institutional arrangement. Public-private cooperation began to become a trend in the field of transport infrastructure. In order to remove the legal obstacles in this field, the German government has made new regulations on the private financing of long-distance highway construction through the "Public-Private Cooperation Promotion Act". When it comes to refinancing, the private sector is starting to have options for charging and fees. From the perspective of law, this paper discusses the legislative background and practical operation of the related problems, analyzes and compares the advantages and disadvantages of the two models, and draws a preliminary conclusion that the gratuitous model is more favorable to the operators.
