【摘要】：隨著中國法學的逐漸恢復和發(fā)展,法學在跨學科的法律研究上有了新進展,這便是在原先的法律研究上更加注重實證的研究方法:社科法學。自從蘇力在討論中國法學格局時提出這一稱謂后,十多年來,社科法學得到了很快的發(fā)展,并且愈加得到法律人的重視。于是,社科法學便與傳統(tǒng)的法教義學逐漸有了對立之勢。在眾多法學的研究方法之中,法教義學能夠恰到好處地體現(xiàn)法律人的知識和思維能力,但是社科法學卻以它自成一派的親和力以及更加能夠對社會額公共政策給予滿足的優(yōu)勢脫穎而出。從目前的發(fā)展狀況來看,社科法學會在中國有一席之地,甚至可能比一些歐美國家發(fā)展得更加出色。本文從社科法學的發(fā)展實況出發(fā),淺談社科法學的跨界格局與實證前景。
[Abstract]:With the gradual recovery and development of Chinese legal science, there has been a new development in the interdisciplinary legal research of law, which is a research method that pays more attention to empirical research in the former legal research: social Science Law. Since Su Li put forward this title when discussing the pattern of Chinese law, the law of social science has developed rapidly in the past ten years, and has been paid more and more attention to by law people. As a result, social science jurisprudence and the traditional doctrine of law gradually have the opposite trend. Among the many research methods of jurisprudence, the doctrine of law can appropriately reflect the knowledge and thinking ability of the legal person. However, social science law stands out because of its unique affinity and its ability to satisfy public policies. Judging from the current situation, the Society of Social Science Law has a place in China, perhaps even better than some European and American countries. Based on the development of social science law, this paper discusses the cross-boundary pattern and empirical prospect of social science law.
