論“親親相隱”制度及其借鑒

【摘要】:“親親相隱”從思想萌芽到形成完善的法律制度,經(jīng)歷了歷朝歷代的演變,該制度的不斷細(xì)化和在實(shí)踐中的不斷貫徹,使中國(guó)傳統(tǒng)法律思想中“儒法結(jié)合”、“禮法合治”下的人倫精神得以彰顯,維護(hù)了家庭親情關(guān)系,協(xié)調(diào)了一定的社會(huì)矛盾,保障了國(guó)家的長(zhǎng)治久安,節(jié)約了一定的司法資源。盡管時(shí)代在不斷前進(jìn),社會(huì)在不斷發(fā)展,人類的親情關(guān)系和家庭制度卻始終存在,反映人類的親情關(guān)系和家庭制度的倫理秩序和倫常道德仍然是必需的。只有當(dāng)法律正確地體現(xiàn)人之常情時(shí),法律才能有真正的權(quán)威,人們也才更容易接受法律,法律裁判才能使人心服口服。經(jīng)過幾千年的世代相承,“親親相隱”已成為中華民族文明進(jìn)步過程中所創(chuàng)造的法律思想,并且此法律思想已進(jìn)化成為一種傳統(tǒng)的、民族的法律文化,上升為一種處于超穩(wěn)定狀態(tài)下的法律意識(shí)。有鑒于此,本文嘗試對(duì)“親親相隱”進(jìn)行研究,以期對(duì)我國(guó)立法、司法實(shí)踐有所裨益。 本文共分為五個(gè)部分對(duì)“親親相隱”予以討論。 第一部分,介紹“親親相隱”的內(nèi)涵、起源和歷史發(fā)展情況等;第二部分,對(duì)“親親相隱”原則所產(chǎn)生的中國(guó)傳統(tǒng)社會(huì)基礎(chǔ)及該原則的適用性進(jìn)行分析;第三部分,介紹大陸法系國(guó)家、英美法系國(guó)家及我國(guó)港澳臺(tái)地區(qū)立法中體現(xiàn)的“親親相隱”原則;第四部分,從人性的基本需要、正義性及法與道德等方面分析當(dāng)代中國(guó)需要對(duì)“親親相隱”原則進(jìn)行借鑒的合理性;第五部分,對(duì)傳統(tǒng)社會(huì)的“親親相隱”制度與現(xiàn)代法律的沖突進(jìn)行分析,并提出當(dāng)代借鑒時(shí)需要注意的問題。
[Abstract]:From the thought germination to the formation of the perfect legal system, the "close relatives hidden" has gone through the evolution of successive dynasties. The continuous refinement of the system and its implementation in practice have led to the "combination of Confucianism and law" in the Chinese traditional legal thought. The spirit of human relations under the combination of etiquette and law has been demonstrated, maintaining family relationships, coordinating certain social contradictions, ensuring the long-term stability of the country, and saving certain judicial resources. In spite of the progress of the times and the development of the society, the family relationship and the family system always exist. It is still necessary to reflect the ethical order and common morality of the family relationship and the family system. Only when the law correctly embodies human common sense, the law can have real authority, people can accept the law more easily, and the judgment of law can make people accept it. After millennia of generations, "closeness between relatives and relatives" has become the legal thought created in the course of the progress of Chinese civilization, and this legal thought has evolved into a traditional, national legal culture. Rise to a kind of legal consciousness that is in superstable state. In view of this, this paper tries to study the "relatives and relatives" in order to benefit the legislation and judicial practice of our country. This paper is divided into five parts to discuss the concealment of relatives and relatives. In the first part, the author introduces the connotation, origin and historical development of "closeness between relatives and relatives", and analyzes the traditional social foundation and applicability of the principle of "closeness between relatives and relatives". The third part introduces the principle of "closeness of kinship" embodied in the legislation of civil law countries, Anglo-American law countries and China's Hong Kong, Macao and Taiwan regions. The fourth part, from the basic needs of human nature, justice, law and morality and other aspects of contemporary China needs to learn from the principle of "close relatives" rationality; In the fifth part, the author analyzes the conflict between the traditional system and modern law, and points out the problems that should be paid attention to when using for reference.
