【摘要】：德國(guó)社會(huì)住房法律制度是德國(guó)社會(huì)保障體制的重要組成部分之一,也是貫徹德國(guó)《基本法》規(guī)定的社會(huì)國(guó)原則的重要體現(xiàn)。目前德國(guó)的社會(huì)住房的法律淵源主要是以聯(lián)邦層級(jí)的《住房資助法》和《住房限定法》為主,并輔之以有關(guān)的條例。在法律關(guān)系上體現(xiàn)了主管機(jī)關(guān)、資助接受人和住房權(quán)利人的三方關(guān)系,并通過(guò)目的限定和價(jià)格限定制度予以保障資助目的的實(shí)現(xiàn),在不取消私法自治和私有財(cái)產(chǎn)權(quán)的條件下完成必要的社會(huì)安全保障目的。
[Abstract]:The legal system of social housing in Germany is one of the important parts of the social security system in Germany, and it is also an important embodiment of the principle of social state stipulated in the basic Law of Germany. At present, the main legal sources of social housing in Germany are the Federal Housing financing Act and the Housing limitation Act, supplemented by relevant regulations. In terms of legal relations, it embodies the tripartite relationship between the competent authority and the recipient and the owner of the housing right, and guarantees the realization of the purpose of the subsidy through the system of purpose limitation and price limitation. The necessary purpose of social security is fulfilled without the abolition of private autonomy and private property rights.
