【摘要】：中國,正處于信息化社會風(fēng)起云涌之時,經(jīng)濟(jì)發(fā)展在滿足人們物質(zhì)生活的同時,也激發(fā)了人們對民主、參政議政的權(quán)利要求。因此,信息公開已成為政府的必然選擇。我國政府信息公開雖然取得了一些進(jìn)步,但與世界上其他國家相比,還有很大的差距。作為憲法與行政法領(lǐng)域的一個新問題,政府信息公開有其理論和現(xiàn)實(shí)的研究價值,這也正是作者撰寫本文的初衷。本文作者采用橫向法律比較的方法,希望通過對信息公開的理論的探討,借鑒日本的經(jīng)驗,探討我國政府信息公開的立法和實(shí)踐的不足,找出構(gòu)建及完善我國信息公開制度的對策。具體而言,本文的結(jié)構(gòu)和內(nèi)容如下：第一,信息公開的基本理論。對信息公開的概念、產(chǎn)生與發(fā)展的過程進(jìn)行了分析,探討了信息公開與相關(guān)概念的辨析,對信息公開制度形成一個初步的輪廓。第二,日本信息公開法的制定過程及特點(diǎn)。在此又分為兩部分,先介紹了日本信息公開法的整體的制定和發(fā)展軌跡,后介紹日本信息公開法的特點(diǎn)。第三,日本與中國政府信息公開制度發(fā)展的比較分析。通過對我國政府信息公開與日本政府信息公開制度發(fā)展的比較分析,找出我國政府信息公開所存在的問題。第四,我國政府信息公開存在的問題及原因。論述我國政府信息公開存在的不足并就其原因進(jìn)行了深刻的剖析。第五,如何完善我國政府信息公開法律制度。在對我國政府信息公開進(jìn)行了必要性研究,提出能夠完善我國政府信息公開制度的幾點(diǎn)對策,其中包括處理好政府信息公開與保密的關(guān)系、制定統(tǒng)一的政府信息公開法、加快電子政務(wù)的發(fā)展等方面,希望能對我國政府信息公開在新形勢下的發(fā)展提供些可用之策。
[Abstract]:China is in an information-based society, economic development not only meets people's material life, but also stimulates people's right to democracy and participate in politics and deliberation. Therefore, information disclosure has become an inevitable choice for the government. As a new issue in the field of constitution and administrative law, government information disclosure has its theoretical and practical research value, which is the original intention of the author. The author of this paper adopts the method of horizontal legal comparison, hoping to explore the government information through the discussion of the theory of information disclosure and the experience of Japan. In particular, the structure and content of this paper are as follows: Firstly, the basic theory of information disclosure. This paper analyzes the concept of information disclosure, the process of its emergence and development, discusses the discrimination between information disclosure and related concepts, and the information disclosure system. Secondly, the formulation process and characteristics of Japan's information disclosure law are divided into two parts. First, the overall formulation and development of Japan's information disclosure law are introduced, then the characteristics of Japan's information disclosure law are introduced. Thirdly, the comparative analysis of the development of Japan's and China's information disclosure system is made. Fourthly, the problems and reasons of the government information disclosure are discussed. The deficiencies of the government information disclosure are discussed and the reasons are analyzed. Fifthly, how to improve the government information disclosure is discussed. This paper studies the necessity of the government information disclosure in China, and puts forward some countermeasures to improve the government information disclosure system, including dealing with the relationship between the government information disclosure and secrecy, formulating a unified government information disclosure law, and speeding up the development of e-government, etc. Information disclosure provides some useful strategies for the development of the new situation.
