【摘要】： 復(fù)仇現(xiàn)象既是社會(huì)現(xiàn)象也是法律現(xiàn)象。中國(guó)古代復(fù)仇現(xiàn)象在其產(chǎn)生和發(fā)展中,深受情理法的影響與調(diào)整。在天理、人情的共同影響下,傳統(tǒng)法對(duì)復(fù)仇現(xiàn)象主要是以限制為主,但也有一定的寬容性。復(fù)仇現(xiàn)象是個(gè)體私力救濟(jì)的表現(xiàn),對(duì)于法制具有補(bǔ)充作用。但復(fù)仇現(xiàn)象沖擊了社會(huì)秩序,危害了封建國(guó)家的整體利益,因此其危害性不容忽視。復(fù)仇現(xiàn)象在情理法之間不斷地調(diào)整中呈現(xiàn)出遞減趨勢(shì),但是沒有完全消失。在當(dāng)代國(guó)內(nèi)外復(fù)仇現(xiàn)象出現(xiàn)了新特點(diǎn)和新趨勢(shì),對(duì)此我們需要采取合理的措施進(jìn)行調(diào)整,從而達(dá)到法律效果與社會(huì)效果的統(tǒng)一。
[Abstract]:Revenge is both a social phenomenon and a legal phenomenon. The phenomenon of revenge in ancient China was deeply influenced and adjusted by the law of reason in its emergence and development. Under the influence of human feelings, the traditional law mainly restricts revenge, but it also has some tolerance. Revenge is the manifestation of individual private relief, which is complementary to the legal system. However, the phenomenon of revenge impacts the social order and endangers the whole interests of feudal countries, so its harmfulness can not be ignored. The phenomenon of revenge in the constant adjustment between the rational law showed a decreasing trend, but did not completely disappear. There are new features and new trends in the phenomenon of revenge at home and abroad. We need to take reasonable measures to adjust it so as to achieve the unity of legal effect and social effect.
