【摘要】：漢初從秦朝繼承而來的三族刑于呂后元年(前187年)被廢除,呂后八年(前180年)呂后死后再次被制定,文帝元年(前179年)又再次被廢除,文帝后元元年(前163年)至七年(前157年)之間又再次被制定。廢除三族刑的背景有戰(zhàn)國以來的三族刑廢除論,以及解除秦朝苛法這一漢朝基本國策。相對于此,重新制定三族刑,則是由于通過對呂氏政權(quán)的政變及新垣平的大逆案件,重新認(rèn)識(shí)到三族刑的威攝效果,以及廢除三族刑并沒有給國家?guī)韺?shí)際益處。
[Abstract]:The punishment of three families inherited from the Qin Dynasty in the early Han Dynasty was abolished in the first year of Luhou (1877), after the death of Lu Hou eight years (180 years before), and again in the first year of Wen Di (179-year-old). Between the first year of the Yuan Dynasty (163 years before) and the seventh year (157 years before), Emperor Wen was again established. The background of abolishing the three-clan punishment is the abolition of the three-clan punishment since the warring States period, and the dissolution of the harsh law of the Qin Dynasty, the basic state policy of the Han Dynasty. In contrast, the reformulation of the three-clan punishment is due to the fact that the coup against Lu's regime and the great reversion of Xinyuanping's case, the realization of the deterrent effect of the three-clan punishment and the abolition of the three-clan punishment have not brought practical benefits to the country.
