【摘要】：在國(guó)家權(quán)力結(jié)構(gòu)中,立法權(quán)、行政權(quán)、警察權(quán)、監(jiān)察權(quán)、監(jiān)管權(quán)、檢察權(quán)、公訴權(quán)、司法權(quán)等,是一系列既相互聯(lián)系又有明顯區(qū)別的權(quán)力體系。其中,法律監(jiān)督權(quán)與經(jīng)濟(jì)監(jiān)管權(quán)、司法警察權(quán)、行政監(jiān)察權(quán)、經(jīng)濟(jì)公訴權(quán)之間存在著許多權(quán)力交叉和矛盾。文章試圖在對(duì)世界各主要國(guó)家相關(guān)權(quán)力配置情況進(jìn)行系統(tǒng)梳理的基礎(chǔ)上,找出法律監(jiān)督權(quán)與經(jīng)濟(jì)監(jiān)管權(quán)、司法警察權(quán)和經(jīng)濟(jì)公訴權(quán)分配的一般規(guī)律。并據(jù)此提出我國(guó)法律監(jiān)督權(quán)、經(jīng)濟(jì)監(jiān)管權(quán)、司法警察權(quán)和經(jīng)濟(jì)公訴權(quán)合理配置的方案。
[Abstract]:In the structure of state power, legislative power, executive power, police power, supervision power, procuratorial power, public prosecution power, judicial power and so on, are a series of power systems which are related to each other and have obvious differences. Among them, there are many power intersections and contradictions between the power of legal supervision and the right of economic supervision, the power of judicial police, the right of administrative supervision and the right of economic public prosecution. This paper tries to find out the general law of the distribution of legal supervision power and economic supervision power, judicial police power and economic public prosecution right on the basis of systematically combing the distribution of relevant powers in major countries in the world. Based on this, the author puts forward the scheme of rational allocation of the right of legal supervision, economic supervision, judicial police and economic public prosecution in our country.
