【摘要】：正確理解保險人代位求償權(quán)的法律性質(zhì),解決保險人代位求償權(quán)在審判實踐中所遇到的各種實際問題,維護保險人、被保險人和第三者的正當(dāng)合法權(quán)益,協(xié)調(diào)和平衡三者的權(quán)利義務(wù)關(guān)系,是本文主要的研究內(nèi)容和重點。本文以一起典型的保險人代位求償權(quán)糾紛案件為例,在簡要介紹案件情況,各方當(dāng)事人的主要觀點的基礎(chǔ)上,對本案所反映的法律問題進行全面深入的分析,同時提出自己的看法和建議。本文重點分析保險人代位求償權(quán)訴訟時效的起算時間與中斷事由、保險人代位求償權(quán)行使對象的確定與限制、禁止被保險人獲得重復(fù)賠償與保障被保險人獲得足額賠償?shù)拿堋⒈ｋU人代位求償權(quán)糾紛案件審理的主要法律關(guān)系等問題。本文借鑒其他學(xué)者的論述與觀點,通過對前述問題的分析探討,對保險人代位求償權(quán)的法律性質(zhì)進行全新的解析和再認識,以求為進一步完善我國現(xiàn)行的保險人代位求償制度,提出自己的見解。
[Abstract]:To correctly understand the legal nature of the insurer's subrogation right, to solve the practical problems encountered in the trial practice of the insurer's subrogation claim, to safeguard the legitimate and legitimate rights and interests of the insurer, the insured and the third party, Coordinating and balancing the relationship between rights and obligations is the main content and focus of this paper. Taking a typical case of insurer's subrogation dispute as an example, based on the brief introduction of the case and the main views of the parties, this paper makes a comprehensive and in-depth analysis of the legal problems reflected in this case. At the same time, put forward their own views and suggestions. This paper focuses on the analysis of the starting time and cause of interruption of the limitation of action for subrogation of the insurer, the determination and limitation of the object of the exercise of the right of subrogation of the insurer, the contradiction between prohibiting the insured from obtaining repeated compensation and ensuring the insured to obtain full compensation. The main legal relationship of subrogation dispute cases. This article draws lessons from other scholars' exposition and viewpoint, through the above question analysis discussion, carries on the brand-new analysis and the understanding to the insurer subrogation right legal nature, in order to further consummate our country's present underwriter subrogation claim system.
