法律內(nèi)在道德的理論分析——簡評富勒《法律的道德性》

【摘要】：法律的內(nèi)在道德被公認為是美國法學(xué)家富勒新自然法思想的精義所在,應(yīng)當(dāng)從三個依次遞進的方面予以理解和把握:法律內(nèi)在道德的提出有其特定的多方面條件;法律內(nèi)在道德的展開有其獨特的理論進路與學(xué)術(shù)內(nèi)涵;有關(guān)法律內(nèi)在道德的論戰(zhàn),豐富并發(fā)展了論戰(zhàn)雙方的思想體系,為法理學(xué)知識的增進做出了創(chuàng)造性的理論貢獻。
[Abstract]:The inherent morality of law is recognized as the essence of the new natural law thought of American jurist Fuller, which should be understood and grasped from three aspects in turn. The development of the inner morality of law has its unique theoretical path and academic connotation, and the controversy about the inner morality of law enriches and develops the ideological system of both sides in the debate, and makes a creative theoretical contribution to the enhancement of the knowledge of jurisprudence.
