【摘要】：基于城鄉(xiāng)二元格局與經(jīng)濟發(fā)展不平衡的背景,我國社會保障地方性立法因利益與體制雙重障礙而頻現(xiàn)沖突,這不僅阻礙了勞動力的自由流動,而且延緩了我國社會保障法律體系化建設進程�；跉W盟社會保障立法沖突協(xié)調(diào)機制的成功經(jīng)驗,以及長三角社保一體化進程中所形成地方立法沖突協(xié)調(diào)機制的實踐,我國應以"制定地方性法律選擇規(guī)范、構建‘法治型’社會保障地方性立法協(xié)調(diào)機制、建立立法利益補償機制、完善公民有序參與機制"等為基石,開辟社會保障地方性立法由沖突到和諧的科學路徑。
[Abstract]:Based on the background of the imbalance between urban and rural dual pattern and economic development, the local legislation of social security of our country frequently conflicts because of the double obstacle of interest and system, which not only hinders the free flow of labor force. And has delayed our country social security legal system construction progress. Based on the successful experience of the coordination mechanism of social security legislation conflict in the EU and the practice of the local legislation conflict coordination mechanism formed in the process of social security integration in the Yangtze River Delta, our country should make the local law choice norm. The scientific path from conflict to harmony of local legislation of social security should be established on the basis of constructing the coordination mechanism of local legislation of 'rule of law', establishing compensation mechanism of legislative interests and perfecting the mechanism of citizen's orderly participation.
