【摘要】： 隨著改革開放和社會主義市場經(jīng)濟建設(shè)的深化,地方立法的步驟加快,立法數(shù)量也在不斷的增加。地方立法是我國立法體制的有機組成部分,是中央立法的補充,在社會主義法制建設(shè)中起著舉足輕重的作用。地方立法和人民的切身利益關(guān)系密切,直接影響著廣大人民群眾的日常生活。改革開放以來,地方立法的加強和改進取得了很大的成就,為我國法制建設(shè)提供了良好的平臺。但是,我們也應(yīng)看到,地方立法還存在一些不足之處。地方立法的質(zhì)量問題嚴(yán)重影響其在現(xiàn)實生活中的可操作性。當(dāng)前,我國正處于社會主義市場經(jīng)濟體制和現(xiàn)代法制的構(gòu)建過程中,在此時代條件下深入研究我國地方立法制度存在的不足和弊端,并尋求解決的途徑和方法,已成為立法工作中的一項重要的課題。對于提高我國地方立法質(zhì)量推進我國法制建設(shè)具有重要的理論意義和現(xiàn)實價值。本文的寫作思路為：首先介紹了地方立法的涵義并從地方性、復(fù)雜性、從屬性和自主性幾方面闡述了地方立法的特征,然后分析了我國地方立法的價值。其次,從中央立法和地方立法權(quán)限入手分析了中央立法和地方立法的關(guān)系。再次,指出了我國地方立法存在的一系列問題,如缺乏地方立法特色,部門利益傾向嚴(yán)重,立法準(zhǔn)備工作不完善,草案起草工作需要改革,聽證制度有待完善等。最后,針對地方立法制度中存在的問題提出一些完善地方立法的實效性建議。
[Abstract]:With the deepening of reform and opening up and the construction of socialist market economy, the steps of local legislation are speeding up and the number of legislation is constantly increasing. Since the reform and opening up, great achievements have been made in strengthening and improving local legislation, which provides a good platform for the legal system construction in China. However, we should also see that there are still some shortcomings in local legislation. The quality of local legislation seriously affects its reality. At present, China is in the process of constructing the socialist market economic system and the modern legal system. Under the conditions of this era, it has become an important task in the legislative work to study the shortcomings and drawbacks of the local legislative system and to seek solutions. It is of great theoretical and practical significance to promote the construction of the legal system in China by improving the quality of local legislation. This paper first introduces the meaning of local legislation and expounds the characteristics of local legislation from the aspects of locality, complexity, attributes and autonomy, then analyzes the value of local legislation in China. Secondly, it analyzes the central legislation. Thirdly, it points out a series of problems in our local legislation, such as the lack of local legislative characteristics, the serious tendency of departmental interests, the imperfection of legislative preparation, the need to reform the drafting of the draft, and the need to improve the hearing system. The existing problems in the system put forward some suggestions for improving the effectiveness of local legislation.
