【摘要】： 法律語言學(xué)是法學(xué)與語言學(xué)相結(jié)合的一門邊緣科學(xué),它是應(yīng)用語言學(xué)中的一個(gè)分支。本論文目的在于闡釋語用學(xué)原理并運(yùn)用于該學(xué)科,同時(shí)加強(qiáng)我國的法律體制建設(shè)。法律術(shù)語翻譯是法律語言學(xué)研究中的一個(gè)熱門話題。隨著法律全球化的進(jìn)展,法律翻譯日益重要。本文首先簡要介紹了國內(nèi)外法律術(shù)翻譯研究的現(xiàn)狀、存在的問題及發(fā)展趨向等問題。然后從法律術(shù)語的定義、特征、分類、語用功能及法律術(shù)語翻譯的重要性角度進(jìn)行了概述。接著主要探討了語用原則指導(dǎo)下的法律術(shù)語翻譯,試圖分析如何將語用學(xué)原理運(yùn)用于法律術(shù)語翻譯,以示等效。結(jié)合語用學(xué)與翻譯學(xué)理論,試圖提出法律術(shù)語翻譯的新方法,力圖改變傳統(tǒng)的法律術(shù)語翻譯及其局限性,更好地促進(jìn)法律術(shù)語翻譯研究的新發(fā)展。同時(shí)結(jié)合前面的理論和研究成果,分析了法律術(shù)語翻譯中出現(xiàn)語用失誤現(xiàn)象的問題,著重對(duì)不同法律體系、不同語言及不同文化之間的差異所引起的語用失誤現(xiàn)象進(jìn)行分析。
[Abstract]:Forensic linguistics is a frontier science of law and linguistics, which is a branch of applied linguistics. The purpose of this thesis is to explain the principle of pragmatics and apply it to this subject, and to strengthen the construction of legal system in China. The translation of legal terms is a hot topic in the study of forensic linguistics. With the development of legal globalization, legal translation is becoming more and more important. Firstly, this paper briefly introduces the current situation, existing problems and development trends of legal translation studies at home and abroad. Then it summarizes the definition, characteristics, classification, pragmatic functions and the importance of legal terms translation. Secondly, this paper mainly discusses the translation of legal terms under the guidance of pragmatic principles, and tries to analyze how to apply pragmatic principles to the translation of legal terms in order to show the equivalence. Based on the theories of pragmatics and translatology, this paper tries to put forward a new method of legal term translation in order to change the traditional legal term translation and its limitation, and to promote the new development of legal term translation research. Combined with the previous theories and research results, this paper analyzes the phenomenon of pragmatic failure in the translation of legal terms, and focuses on the pragmatic failure caused by the differences between different legal systems, different languages and different cultures.
