【摘要】：南宋王朝在我國歷史的發(fā)展過程中延續(xù)時間只有百余年,但是在我國歷史上發(fā)揮的作用卻很大,尤其在經(jīng)濟、文化、科技方面都取得了輝煌的成就。在思想領(lǐng)域,南宋時期是程朱理學(xué)發(fā)展的鼎盛時期,以葉適為代表的永嘉學(xué)派與理學(xué)、心學(xué)并稱,三者成鼎足之勢。葉適思想的形成與發(fā)展深受當(dāng)時南宋社會狀況的影響,葉適在哲學(xué)、功利主義思想等方面成就突出,其哲學(xué)思想與功利主義思想構(gòu)成了其思想體系的基礎(chǔ)。法律思想作為葉適思想的重要組成部分,有其獨特性,以政治思想為依托。所以本文從葉適對法的認知,對南宋法律存在的弊端方面以及葉適任人行法的行政法思想方面對葉適的法律思想進行了探討,希望對葉適的政法思想進行全面了解。
[Abstract]:The Southern Song Dynasty lasted for only over a hundred years in the history of our country, but it played a great role in the history of our country, especially in economy, culture, science and technology. In the ideological field, the Southern Song Dynasty was the heyday of the development of Neo-Confucianism of Cheng and Zhu. The formation and development of Ye Shi's thoughts were deeply influenced by the social conditions of the Southern Song Dynasty at that time. Ye Shi made outstanding achievements in philosophy and utilitarianism, and his philosophical thought and utilitarian thought formed the foundation of his thought system. As an important part of Ye Shi's thought, legal thought is unique and based on political thought. Therefore, this paper discusses Ye Shi's legal thought from the aspects of Ye Shi's cognition of law, the malpractice of law in Southern Song Dynasty, and the thought of administrative law of Ye Shi's personal conduct law, hoping to have a comprehensive understanding of Ye Shi's political and legal thought.
