【摘要】： 立法語(yǔ)言是法律文本的文字表意系統(tǒng)。研究立法語(yǔ)言對(duì)準(zhǔn)確傳達(dá)立法意圖、維護(hù)法律權(quán)威、實(shí)現(xiàn)良法之治有著重要意義。 本文第一章闡述立法語(yǔ)言的概念和本質(zhì)屬性,同時(shí)對(duì)與此相關(guān)的兩個(gè)概念,即立法技術(shù)和法律語(yǔ)言進(jìn)行了闡釋。第二章在上述基礎(chǔ)上,對(duì)我國(guó)立法語(yǔ)言運(yùn)用中出現(xiàn)的實(shí)際問(wèn)題,即立法語(yǔ)言失范化現(xiàn)象,進(jìn)行了歸類研究,認(rèn)為其突出問(wèn)題有形式性問(wèn)題和實(shí)質(zhì)性問(wèn)題,并分析其原因。第三章在探討立法語(yǔ)言規(guī)范化的對(duì)策。其中包括：解決形式性問(wèn)題需要從重視立法語(yǔ)言研究以及建立立法語(yǔ)言審查程序著手,解決實(shí)質(zhì)性問(wèn)題需要處理好兩對(duì)矛盾：準(zhǔn)確性與模糊性的矛盾以及專業(yè)化與通俗化的矛盾。
[Abstract]:Legislative language is the text meaning system of legal text. The study of legislative language is of great significance to accurately convey legislative intention, maintain the authority of law and realize the governance of good law. The first chapter expounds the concept and nature of legislative language, and explains two related concepts, namely, legislative technology and legal language. The second chapter, on the basis of the above, classifies and studies the practical problems in the use of legislative language in our country, that is, the phenomenon of legislative language anomie, and considers that the outstanding problems have formal and substantive problems, and analyzes its causes. The third chapter discusses the countermeasures of the standardization of legislative language. These include the need to address formal issues by focusing on the study of legislative language and the establishment of a legislative language review process, To solve substantive problems, we should deal with two pairs of contradictions: the contradiction between accuracy and fuzziness, and the contradiction between specialization and popularization.
