黨內(nèi)民主法制化建設(shè)研究

【摘要】：中國(guó)政治體制改革的方向是建立社會(huì)主義民主政治。對(duì)于建設(shè)什么樣的社會(huì)主義民主政治、怎么樣建設(shè)社會(huì)主義民主政治,基于中國(guó)共產(chǎn)黨的執(zhí)政地位、新中國(guó)的建設(shè)和發(fā)展歷程和中國(guó)當(dāng)下的民主現(xiàn)狀,人們普遍認(rèn)為黨內(nèi)民主建設(shè)是發(fā)展人民民主、建設(shè)社會(huì)主義民主政治的關(guān)鍵,而黨內(nèi)民主法制化構(gòu)成了黨內(nèi)民主建設(shè)的重要方面。 本文主要從黨內(nèi)民主法制化的角度來(lái)分析、論證并展望中國(guó)共產(chǎn)黨的黨內(nèi)民主法制化,提出黨內(nèi)民主法制化的關(guān)鍵是在黨的選舉、決策、管理和監(jiān)督等層面推動(dòng)民主,擴(kuò)大黨內(nèi)選舉的范圍,規(guī)范黨內(nèi)權(quán)力的運(yùn)作機(jī)制,增強(qiáng)黨內(nèi)民主監(jiān)督的力度,最終通過(guò)不斷的民主實(shí)踐將黨內(nèi)民主進(jìn)行規(guī)范化、制度化、法制化,在黨內(nèi)民主水平上能夠有質(zhì)的提升,并以此為基礎(chǔ)推進(jìn)人民民主和社會(huì)主義民主政治進(jìn)程。本文共分為五個(gè)部分： 第一章為黨內(nèi)民主法制化的概述。主要分析了黨內(nèi)民主法制化的基本內(nèi)涵、特征和發(fā)展歷程。區(qū)分了黨內(nèi)民主與政黨政治、民主政治的不同,提出了黨內(nèi)民主法制化在價(jià)值追求上應(yīng)該以最終實(shí)現(xiàn)民主政治為歸宿,在建設(shè)目標(biāo)上應(yīng)當(dāng)實(shí)現(xiàn)政黨的法制化,在實(shí)現(xiàn)路徑應(yīng)該是遵從漸進(jìn)式改良的方案。同時(shí),在第一章中也簡(jiǎn)要地對(duì)我黨的黨內(nèi)民主建設(shè)的歷程進(jìn)行了歸納和總結(jié),使我們能夠從歷史實(shí)踐的角度進(jìn)一步看到我國(guó)加強(qiáng)黨內(nèi)民主法制化的必要性和緊迫性。 第二章論述了黨內(nèi)民治法制化的必然性。本部分主要從經(jīng)濟(jì)、政治、黨自身的執(zhí)政能力加強(qiáng)以及黨內(nèi)民主法制化對(duì)于民主政治的巨大推動(dòng)作用等幾個(gè)方面闡釋了黨內(nèi)民主法制化是歷史的必然。就經(jīng)濟(jì)層面來(lái)說(shuō),社會(huì)主義市場(chǎng)經(jīng)濟(jì)的發(fā)展為黨內(nèi)民主法制化提供了強(qiáng)大的經(jīng)濟(jì)基礎(chǔ)和社會(huì)基礎(chǔ)；就社會(huì)層面來(lái)說(shuō),社會(huì)發(fā)展的多元化對(duì)黨內(nèi)民主法制化提出了客觀要求,而就政治層面來(lái)說(shuō),社會(huì)階層的分化以及黨的改革任務(wù)使得黨內(nèi)民主具有了現(xiàn)實(shí)的必然性。 第三章論述了我國(guó)當(dāng)前黨內(nèi)民主的實(shí)踐情況并對(duì)實(shí)踐中出現(xiàn)的問(wèn)題和弊端進(jìn)行了分析。這一部分主要是從黨內(nèi)民主選舉、民主決策以及民主監(jiān)督等三個(gè)方面論述了黨內(nèi)民主的實(shí)踐情況。就黨內(nèi)民主選舉制度來(lái)說(shuō),在候選人提名制度、差額選舉制度、黨內(nèi)競(jìng)選制度等方面還有相當(dāng)大的制度空間,這也是實(shí)現(xiàn)黨內(nèi)民主法制化的難點(diǎn)；就黨內(nèi)決策制度來(lái)說(shuō),要加強(qiáng)對(duì)于權(quán)力運(yùn)行的機(jī)制體制的改革,主要方向是改變權(quán)力過(guò)于集中的黨委常委會(huì)制度,將其納入法制化的軌道；就黨內(nèi)民主監(jiān)督而言,主要是要進(jìn)一步在監(jiān)督的主體、程序等問(wèn)題上加強(qiáng)法制化建設(shè)。 第四章論述了當(dāng)代西方國(guó)家的黨內(nèi)民主法制化的建設(shè)。這一部分主要是以美國(guó)、德國(guó)兩個(gè)發(fā)達(dá)國(guó)家的政黨黨內(nèi)民主的發(fā)展歷程為素材,探索了西方的黨內(nèi)民主法制化建設(shè)對(duì)于我國(guó)執(zhí)政黨的參考價(jià)值。西方政黨經(jīng)過(guò)了幾百年的漫長(zhǎng)發(fā)展,在黨內(nèi)民主法制化建設(shè)上積累了一些值得吸取的經(jīng)驗(yàn)教訓(xùn),在實(shí)現(xiàn)黨內(nèi)民主與人民民主對(duì)接以及防止黨內(nèi)民主異化兩個(gè)問(wèn)題上,更加值得我們注意。 第五章提出了對(duì)推進(jìn)黨內(nèi)民主法制化的思考和建議,主要是從保障黨員民主權(quán)利、完善黨內(nèi)權(quán)力運(yùn)行體制機(jī)制以及提高黨內(nèi)監(jiān)督的法制化水平等三個(gè)方面進(jìn)行了論述。黨員民主權(quán)利是實(shí)現(xiàn)黨內(nèi)民主法制化的基礎(chǔ)性保障,黨內(nèi)權(quán)力運(yùn)行機(jī)制的規(guī)范化是實(shí)現(xiàn)黨內(nèi)民主法制化的關(guān)鍵領(lǐng)域,提升黨內(nèi)民主監(jiān)督的法制化水平是黨內(nèi)民主法制化的重要環(huán)節(jié)。 本文的結(jié)語(yǔ)部分則提出了黨內(nèi)民主法治化進(jìn)程上的一個(gè)重要任務(wù)——政黨法的立法問(wèn)題,強(qiáng)調(diào)我國(guó)進(jìn)行政黨立法的可行性和必要性。
[Abstract]:The direction of the reform of China's political system is to establish a socialist democratic politics. For the construction of what kind of socialist democracy, how to build a socialist democratic politics, the ruling status of the Communist Party of China, the course of the construction and development of the new China and the present situation of the people of the people in China, it is generally believed that the construction of Democratic Party democracy is the issue. It is the key to developing people's democracy and building socialist democratic politics, and inner party democracy and legalization constitute an important aspect of Inner Party democracy construction.
This paper analyzes the legal system of the party's democracy, demonstrates and looks forward to the legal system of the party's democracy in the party. The key to the legalization of the party's democracy is to promote democracy in the party's election, decision-making, management and supervision, to expand the scope of the party's election, to standardize the operation mechanism of the party's power and to strengthen the supervision of the Democratic Party in the party. Finally, through continuous democratic practice, the inner party democracy is standardized, institutionalized and legalized, and the democratic level in the party can be promoted in quality. On this basis, the people's democracy and the socialist democratic political process are promoted. This article is divided into five parts:
The first chapter is an overview of the institutionalization of Democratic Party democracy. It mainly analyzes the basic connotation, characteristics and development course of the inner-party democracy. It distinguishes the difference between the party democracy and the political party politics and the democratic politics, and puts forward that the internal party democracy should be legalized in the pursuit of the final realization of the people's main politics, and should be realized on the construction goal. In the first chapter, the process of the party's democratic construction is summarized and summed up in the first chapter, so that we can further see the necessity and urgency of strengthening the institutionalization of the party's civil law in our country from the perspective of historical practice.
The second chapter expounds the inevitability of the rule of law in the party. This part explains the inevitability of the legalization of democracy within the party from the economic, political, strengthening of the party's own ruling ability and the great impetus to democracy in the party, and the development of the socialist market economy in the economic level. It provides a strong economic basis and social basis for the legal system of inner-party democracy; on the social level, the pluralism of social development puts forward objective demands on the legal system of Democratic Party, and on the political level, the differentiation of social stratum and the task of the party's reform make the inner-party owners have realistic inevitability.
The third chapter discusses the practical situation of the party democracy in our country and analyzes the problems and shortcomings in the practice. This part mainly discusses the practice of Democratic Party democracy in three aspects, such as democratic election in the party, democratic decision-making and democratic supervision, and the system of nomination for the democratic election in the party is poor. There are considerable institutional space in the system of the election and the system of the party. It is also the difficult point to realize the legal system of democracy in the party. In the party decision-making system, the reform of the mechanism system for power operation is to be strengthened. The main direction is to change the system of the Standing Committee of the Party committee with too much power and bring it into the track of the legal system. In terms of democratic supervision within the party, it is necessary to further strengthen the legalization construction on the subjects and procedures of supervision.
The fourth chapter discusses the construction of the legal system of the Democratic Party in the contemporary western countries. This part is mainly based on the development course of the party democracy in the two developed countries of the United States and Germany, and explores the value of the reference value of the construction of the democratic legal system in the West for the ruling party in the West. We have accumulated some lessons that deserve to be learned in the construction of the legal system of democracy within the party. We should pay more attention to the two problems of realizing the docking of democracy in the party and the people's democracy and preventing the inner-party democratic alienation.
The fifth chapter puts forward the thinking and suggestions on promoting the legal system of democracy in the party, mainly from three aspects, which are to guarantee the democratic rights of the party members, to perfect the system mechanism of the operation of the party's power and to improve the legal level of the inner party supervision. The standardization of mechanism is the key area to realize the inner party democracy and legalization. Improving the legalization level of democratic supervision within the party is an important link in the inner party democracy and legalization.
The concluding part of this article puts forward an important task in the process of the rule of law in the party democracy - the legislative issue of the party law, which emphasizes the feasibility and necessity of the legislation of China's administrative party.
