【摘要】：自上世紀(jì)90年代以來,由美國國內(nèi)關(guān)于是否接受"烏拉圭回合一攬子協(xié)議"所導(dǎo)致的"1994年主權(quán)大辯論"為開端,對于"主權(quán)"在當(dāng)代國際經(jīng)貿(mào)政策規(guī)范的制定、實施過程中所起作用這一關(guān)鍵問題,美國著名國際經(jīng)濟法學(xué)家約翰·杰克遜教授逐漸形成、并撰文發(fā)表了系列觀點,其思維進路即稱為Sovereignty-Modern("當(dāng)代主權(quán)觀")。杰克遜力圖將主權(quán)問題異化為權(quán)力分配的問題,并倡議以實用主義的導(dǎo)向?qū)⒋艘娊馕盏絿业恼邲Q策進程中。對于這種主權(quán)觀,因其內(nèi)在的論證邏輯缺陷和法律價值缺失,尤其應(yīng)予審慎剖析和辯證評價。
[Abstract]:Since the 1990s, starting with the "1994 sovereignty debate" in the United States concerning whether or not to accept the Uruguay Round package Agreement, the formulation of the norms of "sovereignty" in contemporary international economic and trade policies has begun. Professor John Jackson, a famous American international economic law scientist, has gradually formed the key issue of the function in the process of implementation, and has written a series of viewpoints, the thinking path of which is called Sovereignty-Modern ("the Contemporary View of sovereignty"). Jackson tried to dissimilate the issue of sovereignty into the issue of power distribution, and advocated the pragmatism of the guidance to absorb this view into the country's policy decision-making process. This view of sovereignty, due to its inherent logic defects and lack of legal value, especially should be carefully analyzed and dialectical evaluation.
