【摘要】： 凱爾森創(chuàng)立的純粹法學(xué)是法學(xué)理論中的一座里程碑,在為法律爭取獨(dú)立地位的過程中,他不僅與其他實(shí)證主義法學(xué)家一道劃清法律與道德的界限,而且還建構(gòu)了比前人更加嚴(yán)密的法學(xué)理論,為法律理論的發(fā)展做出了卓越的貢獻(xiàn)。純粹法學(xué)的核心就是基礎(chǔ)規(guī)范,對此人們有很多爭論。本文首先探討了基礎(chǔ)規(guī)范的理論背景,這主要從三個角度來探討,一個是純粹法學(xué)多元化的哲學(xué)根基,一個是該理論建構(gòu)的方法論,還有構(gòu)建過程中的反意識形態(tài)立場;其次闡述了對基礎(chǔ)規(guī)范的相關(guān)認(rèn)識,包括基礎(chǔ)規(guī)范的作用、內(nèi)容和性質(zhì);最后就基礎(chǔ)規(guī)范的相關(guān)批判做了幾點(diǎn)追問,包括法律體系的同一性問題、規(guī)范的純粹性問題和規(guī)范認(rèn)識主體問題,以求更加透徹地理解基礎(chǔ)規(guī)范。
[Abstract]:The pure law founded by Kelsen is a milestone in the theory of law. In the process of striving for the independence of law, he not only drew the boundary between law and morality together with other positivist jurists. Moreover, the author constructed a more rigorous legal theory than his predecessors, and made outstanding contributions to the development of legal theory. The core of pure law is the basic norms, which people have a lot of controversy. This paper first discusses the theoretical background of basic norms, which is mainly discussed from three angles, one is the philosophical foundation of pure legal pluralism, the other is the methodology of the theoretical construction, and the anti-ideological position in the process of construction; Secondly, it expounds the related understanding of the basic norms, including the role, content and nature of the basic norms. Finally, it makes several questions about the criticism of the basic norms, including the identity of the legal system. In order to understand the basic norms more thoroughly, the pureness of norms and the subject of norms should be recognized.
