【摘要】：在美國(guó),隨著《聯(lián)邦民權(quán)法案》、《雇傭年齡歧視法案》以及《美國(guó)殘疾人法案》的修改完善,公司董事遭受雇員訴訟的風(fēng)險(xiǎn)進(jìn)一步增大。許多保險(xiǎn)公司抓住這一商機(jī),在董事責(zé)任保險(xiǎn)中附加了雇傭責(zé)任保險(xiǎn),還有一些保險(xiǎn)公司則推出了獨(dú)立的雇傭責(zé)任保險(xiǎn)(EPLI)單獨(dú)進(jìn)行銷(xiāo)售。雖然目前我國(guó)尚無(wú)保險(xiǎn)公司銷(xiāo)售雇傭責(zé)任保險(xiǎn),但是美國(guó)的雇傭責(zé)任立法和雇傭責(zé)任保險(xiǎn)的發(fā)展歷程,卻值得我們學(xué)習(xí)和借鑒。
[Abstract]:In the United States, as the Federal Civil Rights Act, the Employment Age Discrimination Act and the Americans with Disabilities Act are amended, the risk of company directors being subject to employee litigation increases further. Many insurance companies take advantage of this opportunity, adding employment liability insurance to directors' liability insurance, while others offer separate EPLI for sale. Although there are no insurance companies in China to sell employment liability insurance, the legislation of employment liability and the development of employment liability insurance in the United States are worthy of our study and reference.
