【摘要】：自20世紀(jì)90代以來(lái),全球宗教迎來(lái)了一個(gè)新的發(fā)展期,各種宗教和宗教團(tuán)體如雨后春筍般紛紛涌現(xiàn),家庭教會(huì)(family church)、地下教會(huì)(underground church)和自由教會(huì)(free church)正在英國(guó)、法國(guó)、德國(guó)等歐洲國(guó)家的年輕人中迅速流行起來(lái),方興未艾。在中國(guó),隨著人們宗教信仰選擇的多元和社會(huì)生活壓力的增大,基督教在中國(guó)社會(huì)中取得了前所未有的發(fā)展,團(tuán)體規(guī)模逐漸增大,信徒人數(shù)逐年增多。但是,家庭教會(huì)的合法化仍是一個(gè)懸而未決的問(wèn)題。目前,學(xué)術(shù)界傾向于將宗教組織定性為社會(huì)的"第三部門(mén)",本文正是基于這種視角,運(yùn)用法社會(huì)學(xué)、法理分析的方法,分析家庭教會(huì)的法律性質(zhì)、活動(dòng)范圍、活動(dòng)權(quán)限和未來(lái)發(fā)展趨勢(shì),將家庭教會(huì)"去魅化",討論家庭教會(huì)獲得公開(kāi)化、合法化身份的途徑和方式。本文旨在解決三個(gè)方面的問(wèn)題:(1)"家庭教會(huì)"概念的界定、法律性質(zhì)和存在的原因分析;(2)通過(guò)山東省L鎮(zhèn)家庭教會(huì)的實(shí)地調(diào)研,揭示家庭教會(huì)在社會(huì)實(shí)踐中存在的問(wèn)題;(3)家庭教會(huì)的規(guī)范效應(yīng)與合法化的途徑。
[Abstract]:Since the 20th century, a new period of development has ushered in the world of religions. Various religions and religious groups have sprung up. The family church (family church), underground church (underground church) and the Freedom Church (free church) are now in Britain, France. Young people are rapidly gaining popularity in European countries such as Germany. In China, with the pluralism of people's religious choice and the increasing pressure of social life, Christianity has made unprecedented development in Chinese society, the scale of the group has gradually increased, and the number of believers has increased year by year. But the legalization of the family church is still an open question. At present, the academic circles tend to regard religious organizations as the "third sector" of society. Based on this perspective, this paper analyzes the legal nature and the scope of activities of the family church by using the methods of sociology of law and legal analysis. This paper discusses the ways and means of making the family church open and legalized. The purpose of this paper is to solve three problems: (1) the definition of the concept of "family church", the analysis of the legal nature and the cause of its existence; (2) the field investigation of the family church in L Town, Shandong Province. It reveals the problems existing in the social practice of the family church, (3) the normative effect of the family church and the way of legalization.
