【摘要】:我國(guó)《反不正當(dāng)競(jìng)爭(zhēng)法》規(guī)定了包裝裝潢權(quán),但并沒(méi)有直接規(guī)定商標(biāo)許可合同中產(chǎn)生的包裝裝潢權(quán)的權(quán)益歸屬。相對(duì)而言,美國(guó)不僅規(guī)定了類(lèi)似于包裝裝潢權(quán)的商品外觀權(quán),而且對(duì)商標(biāo)許可合同中的商品外觀權(quán)益歸屬作出了具體規(guī)定。研究美國(guó)相關(guān)制度,有助于我國(guó)對(duì)商標(biāo)許可合同中商譽(yù)歸屬問(wèn)題的深入認(rèn)識(shí)。
[Abstract]:China's Anti-unfair Competition Law stipulates the right of packaging decoration, but it does not directly regulate the rights and interests of packaging and decoration arising from trademark licensing contracts. Comparatively speaking, the United States not only stipulates the right of appearance of goods similar to the right of packaging and decoration, but also specifies the ownership of the rights and interests of commodity appearance in the trademark license contract. The study of the relevant systems in the United States is helpful to the in-depth understanding of the attribution of goodwill in trademark licensing contracts in China.
