【摘要】：社會(huì)主義法治理念是中國共產(chǎn)黨作為執(zhí)政黨，從社會(huì)主義現(xiàn)代化建設(shè)事業(yè)的現(xiàn)實(shí)和全局出發(fā)，借鑒世界法治經(jīng)驗(yàn)，對近現(xiàn)代特別是改革開放以來中國經(jīng)濟(jì)、社會(huì)和法治發(fā)展的歷史經(jīng)驗(yàn)的總結(jié)；它既是當(dāng)代中國社會(huì)主義建設(shè)規(guī)劃的一部分，同時(shí)也是執(zhí)政黨對中國法治經(jīng)驗(yàn)的理論追求和升華。以人為本，是科學(xué)發(fā)展觀的核心，是中國共產(chǎn)黨人堅(jiān)持全心全意為人民服務(wù)的黨的根本宗旨的體現(xiàn)。本文闡述了“以人為本”思想和社會(huì)主義的法治理念的涵義，分析了“以人為本”思想與社會(huì)主義的法治理念融合的必要性，并就二者相互融合的實(shí)踐性進(jìn)行了探討。本文共分五個(gè)部分： 第一部分，緒論。分析了社會(huì)主義法治理念和科學(xué)發(fā)展觀中“以人為本”思想提出的背景，，以及研究二者融合的理論和實(shí)踐意義，并就國內(nèi)外當(dāng)前的研究現(xiàn)狀進(jìn)行分析，為我們更進(jìn)一步研究和探討“以人為本”和社會(huì)主義法治理念的融合奠定基礎(chǔ)。 第二部分，闡述“以人為本”思想和社會(huì)主義法治理念的涵義。分別分析了我國古代“以人為本”思想、西方“人本主義”思想、馬克思主義中的“以人為本”思想和科學(xué)發(fā)展觀中的“以人為本”思想，并從社會(huì)主義理念的依法治國、執(zhí)法為民、公平正義、服務(wù)大局和黨的領(lǐng)導(dǎo)五個(gè)方面進(jìn)行闡述，重點(diǎn)解釋社會(huì)主義理念的涵義。 第三部分，分析“以人為本”思想與社會(huì)主義法治理念融合的必要性。從我國的國家性質(zhì)等多個(gè)方面和角度分析和研究在中國的社會(huì)主義法制建設(shè)中為何有必要將“以人為本”與社會(huì)主義法治理念相融合，為本文的重點(diǎn)研究部分，為后面的內(nèi)容提供理論依據(jù)。 第四部分，探討我國當(dāng)前法治建設(shè)中存在的制度層面和操作層面問題，從立法、執(zhí)法、司法和守法等多個(gè)方面分析研究了如何在具體的社會(huì)主義法治實(shí)踐中融入“以人為本”思想，努力構(gòu)建社會(huì)主義和諧社會(huì)。 第五部分，對本文進(jìn)行總結(jié)。對本文進(jìn)行梳理，提出本文研究的關(guān)鍵部分。
[Abstract]:The idea of socialist rule of law is that the Communist Party of China, as a ruling party, proceeds from the reality and overall situation of the cause of socialist modernization, draws lessons from the experience of the rule of law in the world, and deals with the Chinese economy in modern times, especially since the reform and It is not only a part of the socialist construction plan of contemporary China, but also the theoretical pursuit and sublimation of the ruling party's experience of the rule of law in China. People-oriented is the core of the scientific concept of development and the embodiment of the fundamental purpose of the Communist Party of China which adheres to serving the people wholeheartedly. This paper expounds the meaning of the thought of "people-oriented" and the concept of socialist rule of law, analyzes the necessity of the fusion of "people-oriented" thought and socialist idea of rule of law, and probes into the practicality of the fusion of the two ideas. This paper is divided into five parts: the first part, introduction. This paper analyzes the background of the idea of "people-oriented" in the concept of socialist rule of law and the concept of scientific development, as well as the theoretical and practical significance of the research on the fusion of the two, and analyzes the current research situation at home and abroad. For us to further study and explore the "people-oriented" and socialist concept of the integration of the rule of law lay the foundation. The second part expounds the meaning of the idea of people-oriented and socialist rule of law. This paper analyzes the thought of "people-oriented" in ancient China, "humanism" in the west, "people-oriented" in Marxism and "people-oriented" in the scientific development view, and manages the country according to law from the socialist concept. Law enforcement for the people, fairness and justice, serving the overall situation and the leadership of the party are expounded, with emphasis on explaining the meaning of the socialist concept. The third part analyzes the necessity of merging the idea of people-oriented and socialist rule of law. From many aspects and angles, such as the nature of our country, this paper analyzes and studies why it is necessary to combine "people-oriented" with the concept of socialist rule of law in the construction of socialist legal system in China, which is the key research part of this paper. To provide the theoretical basis for the latter content. The fourth part discusses the problems of system and operation in the current construction of the rule of law in China, from the legislation, law enforcement, This paper analyzes and studies how to integrate the idea of "people-oriented" into the practice of socialist rule of law in order to build a harmonious socialist society. The fifth part summarizes this paper. This paper is combed and the key part of this paper is put forward.
