儒家憲政的傳統(tǒng)與展望

【摘要】:儒家憲政包涵了根源性的政教關(guān)系、共同體治理體系、政體架構(gòu)以及政治主體性與認(rèn)同等基本憲制維度,而致力于使公共權(quán)力的運(yùn)行符合憲制規(guī)則之精神。這個(gè)憲制—憲政視角提供了重新理解中國政治傳統(tǒng)的關(guān)鍵契機(jī),也促使我們反思諸如封建專制、儒法關(guān)系、內(nèi)圣外王、政道治道等流行的敘事套式。儒家憲政提倡一種開放、理性而彰顯公共價(jià)值的憲制會(huì)話,在與古人、西方和各種思想進(jìn)路的對(duì)話中促成積極的共識(shí),而這又有賴于一種儒家公民人格的形成和拓展。
[Abstract]:Confucian constitutionalism includes the basic constitutional dimensions such as the root of the relationship between state and religion, community governance system, political subjectivity and identity, and devotes to making the operation of public power conform to the spirit of constitutional rules. This constitution-constitutional perspective provides a key opportunity to re-understand Chinese political tradition, and also urges us to reflect on popular narrative patterns such as feudal autocracy, Confucian and legal relations, internal and external kings, and political, Taoist and political governance. Confucian constitutionalism advocates an open, rational and public value of constitutional conversation, and promotes a positive consensus in the dialogue with the ancients, the West and various ways of thinking, which in turn depends on the formation and expansion of a Confucian civic personality.
