【摘要】： 本文通過對文獻(xiàn)記載的整理及前人研究的基礎(chǔ)上,對中國古代社會的訟師現(xiàn)象以元代為中心進(jìn)行了較為系統(tǒng)的闡述。訟師的產(chǎn)生、發(fā)展、衰微以及訟師群體在各個(gè)歷史時(shí)期的構(gòu)成和他們在司法活動(dòng)中所起的作用是中國法制史研究領(lǐng)域的新課題。元朝是中國歷史鏈條上的承前啟后的一代封建王朝,作為統(tǒng)治者的草原游牧民族——蒙古族,由于其民族固有傳統(tǒng)致使國家的運(yùn)行方式與中原王朝不盡不同,在“祖述變通”法制原則的引導(dǎo)下,對傳統(tǒng)中原文化注入新的制度因素是難免的。所以對訟師的態(tài)度也與其他朝代有所不同,在對訟師活動(dòng)進(jìn)行禁治的同時(shí),又適當(dāng)給予訟師活動(dòng)空間,將訟師代書活動(dòng)納入法律的調(diào)控之下。元代法制史是中國法律制度史研究中的難點(diǎn)問題,其原因是多方面的,元代訟師研究是這一領(lǐng)域的學(xué)術(shù)空白點(diǎn),也是本文選題的創(chuàng)新之處和意義所在。筆者充分挖掘和利用相關(guān)資料,對元代訟師群體存在的原因與現(xiàn)象、訟師隊(duì)伍的構(gòu)成與來源、元代特定多元法文化司法背景下的生存狀況與司法實(shí)踐中的作用、元朝法典中關(guān)于對訟師的禁治條列以及訟師活動(dòng)低谷的原因等問題進(jìn)行了客觀的探析。
[Abstract]:On the basis of the collation of literature records and the study of previous studies, this paper systematically expounds the phenomenon of the ancient Chinese ancient society with the Yuan Dynasty as the center. The production, development, decline and the composition of the lawsuit division in various historical periods and their role in the judicial activity are the research fields of the history of Chinese legal system. The Yuan Dynasty was a feudal dynasty in the chain of history of China. As the rulers, the Mongolian nomadic people of the grassland, the Mongolian nationality, caused the country's running mode to be different from the Central Plains because of its national inherent tradition. Under the guidance of the principle of "the change of the ancestors", a new system was injected into the traditional culture of the Central Plains. The factors are unavoidable. Therefore, the attitude of the lawsuit teacher is also different from other dynasties. At the same time, the legal system history of the Yuan Dynasty is the difficult problem in the study of the history of the Chinese legal system. The research is the academic blank in this field, and it is also the innovation and significance of this topic. The author fully excavates and uses the relevant information, the causes and phenomena of the existence of the Yuan Dynasty lawsuit division, the composition and source of the lawsuit team, the role of the Yuan Dynasty in the judicial practice of the Yuan Dynasty under the judicial background of the judiciary and the judicial background of the Yuan Dynasty. The article makes an objective analysis of the prohibition of legal punishment and the reasons for the low activity of the legal practitioners.
