法美學(xué)意蘊(yùn)與西部社會(huì)的法治

【摘要】:法的美學(xué)意蘊(yùn)表明法是一種蘊(yùn)含真善美并旨在構(gòu)建秩序與和諧的社會(huì)治理藝術(shù)。儀式是表達(dá)法美學(xué)的主要載體,西部社會(huì)的儀式資源豐富,對(duì)儀式的遵行有助于培養(yǎng)民眾的法律信仰情懷。西部地區(qū)具有社會(huì)治理重"情"、治理資源殘缺等特點(diǎn),而這些恰恰契合法美學(xué)的固有規(guī)律,因?yàn)?情"是法之真善美的基礎(chǔ),而人性的弱點(diǎn)決定了法之美包含殘缺美,因此它們可以作為蘊(yùn)含法之美的社會(huì)治理資源。
[Abstract]:The aesthetic implication of law indicates that law is a kind of art of social governance which contains truth, good and beauty and aims at building order and harmony. Ritual is the main carrier of expression aesthetics, the western society is rich in ritual resources, the observance of ritual helps to cultivate the people's feelings of legal belief. The western region has the characteristics of social governance, such as "emotion", "governance of incomplete resources," and so on, which are precisely in line with the inherent laws of the aesthetics of law, because "emotion" is the basis of the truth, goodness and beauty of law, and the weakness of human nature determines that beauty of law contains incomplete beauty. Therefore, they can be used as social governance resources containing the beauty of law.
