【摘要】：在古典社會(huì),祭祀是最早的憲法制度,個(gè)人、宗教與國家三者通過祭祀合為一體。法律捍衛(wèi)國家宗教的共同信仰,個(gè)人只有投身于公共信仰才能享有法律人格。進(jìn)入中世紀(jì),人的自我意識(shí)首次覺醒,個(gè)人心靈的安頓轉(zhuǎn)變?yōu)樽冯S、信奉耶穌基督從而獲得救贖。此時(shí)的社會(huì)是基督教政教合一的憲制與教權(quán)和王權(quán)斗爭的結(jié)合,個(gè)人的自由與平等被遮蔽。新教改革確立了個(gè)人與上帝的直接救贖關(guān)系,信仰上帝從個(gè)人義務(wù)轉(zhuǎn)變?yōu)閭�(gè)人權(quán)利。現(xiàn)代國家通過創(chuàng)制憲法直接與個(gè)人權(quán)利相聯(lián)系,國家保障個(gè)人宗教信仰自由,抵御教權(quán)對(duì)個(gè)人的干預(yù)。而關(guān)于個(gè)人的心靈安頓問題,現(xiàn)代憲法則訴諸于人民主權(quán)之上的超驗(yàn)的精神淵源——基督教精神傳統(tǒng)。
[Abstract]:In classical society, sacrifice was the earliest constitutional system. The law defends the common faith of the state religion, and the individual can enjoy the legal personality only if he is committed to the public belief. In the Middle Ages, man's self-consciousness awoke for the first time. The society of this time is the combination of the constitution of the Christian church and the right of religion and the struggle of Wang Quan, and the freedom and equality of the individual are obscured. The Protestant Reformation established the direct redemption relationship between the individual and God, and the belief in God changed from personal obligation to individual right. By creating constitution, modern country is directly connected with individual right. The state guarantees individual freedom of religious belief and resists the interference of religious right to individual. With regard to the individual's spiritual settlement, the modern constitution appeals to the transcendental spiritual origin above the sovereignty of the people-the Christian spiritual tradition.
