【摘要】: 親屬相隱制度作為一項(xiàng)在我國(guó)存續(xù)過(guò)兩千多年并且在世界上大部分國(guó)家至今仍在實(shí)行的法律制度,實(shí)有其深厚的社會(huì)結(jié)構(gòu)基礎(chǔ)和文化精神觀念的支撐,其所蘊(yùn)涵的合理性在我們建設(shè)社會(huì)主義法治社會(huì)的今天仍然不容忽視,我國(guó)現(xiàn)行刑事法律對(duì)其完全的否定和拋棄是不明智的。親屬相隱制度不僅體現(xiàn)了法律對(duì)人性的尊重和對(duì)親情的體恤,而且與我們今天所提倡的尊重和保障人權(quán)也具有一致性。親情是人類最基本的感情,家庭是人類社會(huì)最基本的組成單位,其中的血緣關(guān)系、親情關(guān)系使家庭關(guān)系得以存在和維持。我國(guó)自古以來(lái)重視倫理道德,注重維護(hù)倫常綱紀(jì),提倡關(guān)愛(ài)親屬、保護(hù)親屬,對(duì)親情倫理關(guān)系的法律保護(hù)在中國(guó)古代歷朝的法律規(guī)定中都有所體現(xiàn),并已形成一種普遍的社會(huì)心理,有其深厚的社會(huì)基礎(chǔ)。親屬相隱制度正是順乎人類這種最基本的情感而產(chǎn)生的,是從法律上對(duì)人類天然感情和最基本人權(quán)的一種尊重和保護(hù)。一項(xiàng)法律制度的制定和實(shí)施要樹(shù)立其社會(huì)權(quán)威性,發(fā)揮其價(jià)值導(dǎo)向的重要作用,不僅要以嚴(yán)密的理性思維做基礎(chǔ),更重要的是體恤民情,也就是我們現(xiàn)在通常所說(shuō)的以人為本。任何一種法律規(guī)范,只有建立在充分尊重最基本的人性和人權(quán)的基礎(chǔ)上,其存在和適用才具有本質(zhì)上的合理性,也只有這樣人性化的法律在現(xiàn)實(shí)生活中才能得到廣大民眾普遍的遵守和尊重。因此,公正的認(rèn)識(shí)這一制度,重新反思其所蘊(yùn)涵的合理價(jià)值及其現(xiàn)代意義,在我國(guó)現(xiàn)行刑事法律中重構(gòu)具有現(xiàn)代意義的親屬相隱制度,才能更好的體現(xiàn)法律對(duì)公民基本人權(quán)的尊重,體現(xiàn)人性化和人道主義的立法精神,從而更好的維護(hù)家庭和社會(huì)的穩(wěn)定,促進(jìn)我國(guó)社會(huì)主義法治社會(huì)的建設(shè)。 文章共分為五個(gè)部分:第一部分為親屬相隱制度概述,在對(duì)該制度的產(chǎn)生、發(fā)展及其在近現(xiàn)代的演變進(jìn)行梳理的基礎(chǔ)上,分析該制度產(chǎn)生的原因及其所蘊(yùn)涵的合理性因素;第二部分為親屬相隱制度的立法基礎(chǔ)主要從該制度對(duì)人性和家庭倫理的尊重和維護(hù)及其與法律個(gè)別化正義的契合等角度論述該制度之所以在古今中外廣泛存在的深層次原因;第三部分為親屬相隱制度的現(xiàn)代意義,簡(jiǎn)要的分析和闡述了該制度對(duì)我國(guó)當(dāng)今社會(huì)法治社會(huì)建設(shè)的重要意義;第四部分為重設(shè)親屬相隱制度的必要性以及該制度在現(xiàn)行刑事法律中具體建構(gòu)的思考和建議。第五部分為結(jié)語(yǔ),總結(jié)全文對(duì)親屬相隱制度的分析和論述,闡述在我國(guó)現(xiàn)行刑事法律中重構(gòu)親屬相隱制度的必要性,并進(jìn)一步指出該制度對(duì)我國(guó)現(xiàn)階段法治社會(huì)建設(shè)的重要意義。
[Abstract]:As a legal system which has existed in our country for more than two thousand years and is still in practice in most countries of the world, the system of relative concealment is supported by its profound social structure and cultural spirit. The rationality contained in it is still not to be ignored today when we are building a socialist society ruled by law. It is unwise to deny and abandon it completely by the current criminal law of our country. The system of relative concealment not only embodies the respect for human nature and sympathy for the family, but also is consistent with the respect and protection of human rights that we advocate today. Family is the most basic emotion of human beings, and family is the most basic unit of human society. The blood relationship and kinship make the family relationship exist and maintain. Since ancient times, our country has attached great importance to ethics and morality, paid attention to maintaining the principles and disciplines of social order, advocated caring for relatives, and protected relatives. The legal protection of the ethical relationship between family and family has been embodied in the legal provisions of the ancient dynasties in China. And has formed a kind of universal social psychology, has its profound social foundation. The system of relative concealment is a kind of respect and protection of human natural feelings and most basic human rights. The establishment and implementation of a legal system should establish its social authority and play an important role in guiding its value, not only on the basis of strict rational thinking, but also on the understanding of the people's feelings, that is, we usually call it "people-oriented" now. The existence and application of any legal norm is inherently reasonable only if it is based on full respect for the most basic human nature and human rights, Only such humanized law in real life can be widely observed and respected by the general public. Therefore, to understand this system fairly, to rethink its reasonable value and its modern significance, and to reconstruct the relative concealment system with modern significance in the current criminal law of our country. In order to better reflect the law to respect the basic human rights of citizens, reflect the humanization and humanitarian spirit of legislation, thereby better maintain the stability of the family and society, and promote the construction of our socialist society ruled by law. The article is divided into five parts: the first part is an overview of the relative implicit system. On the basis of combing the emergence, development and evolution of the system in modern times, this paper analyzes the reasons for the emergence of the system and the reasonable factors contained therein; The second part is the legislative basis of the system of relative concealment, mainly from the system of respect and maintenance of human nature and family ethics and its agreement with the individual justice of the law and other angles to discuss the deep-seated reasons why the system widely exists in ancient, modern and modern times. The third part is the modern significance of the system of relative concealment, which briefly analyzes and expounds the important significance of this system to the construction of our country's society under the rule of law. The fourth part is about the necessity of re-setting up the relative concealment system and its concrete construction in the current criminal law. The fifth part is the conclusion, which summarizes the analysis and discussion of the relative concealment system in the full text, and expounds the necessity of reconstructing the relative concealment system in the current criminal law of our country. Furthermore, it points out the significance of this system to the construction of the society ruled by law at the present stage of our country.
