【摘要】： 社會權(quán)作為晚近誕生的新型權(quán)利,在學(xué)界尚存爭議。從公權(quán)利與私權(quán)利、積極權(quán)與消極權(quán)、個別權(quán)與普遍權(quán)這三重維度對社會權(quán)加以審視有助于增進對社會權(quán)性質(zhì)的認識。追尋社會權(quán)在古代社會、中世紀、近代和現(xiàn)代不斷閃現(xiàn)的身影,深感社會權(quán)歷史之悠遠,人類情懷之可貴。社會權(quán)的反對意見亦緊緊跟隨,給人以警醒。從人性根基、理論支撐、實踐支撐三個層面給社會權(quán)以理論證成,深感社會權(quán)思想積淀之厚實,精神內(nèi)核之豐盈。社會權(quán)的具體內(nèi)容包括社會保障權(quán)、勞動權(quán)、受教育權(quán)等,關(guān)涉有尊嚴的生活能否達至。“人是普遍的弱者”,人皆有成為弱者的可能。社會權(quán)關(guān)照的,是茫茫人海中的每一個人。
[Abstract]:As a new type of rights, social rights are still controversial in academic circles. It is helpful to improve the understanding of the nature of social rights from the perspectives of public and private rights, positive rights and negative rights, individual rights and universal rights. The pursuit of social rights in ancient society, the Middle Ages, modern times and modern constantly flashed out, deeply felt the history of social rights and the value of human feelings. The opposition to social rights followed closely, alerting people. From the human nature foundation, the theory support, the practice support three aspects to the social right to the reason argument, deeply feels the social right thought accumulation thick, the spiritual core is abundant. The specific contents of social rights include the right to social security, the right to work, the right to education and so on. "Man is the general weak", and all people have the possibility of becoming weak. Social rights care for everyone in the vast crowd.
