【摘要】："中人"是中華法系契約文明的重要內(nèi)容,也是清代土地買賣契約中的重要的法律現(xiàn)象。在清代的土地買賣契約中,所有的契約差不多都有"中人"參與,并在契約中發(fā)揮著重要作用。出賣人所在地德高望重者和與出賣人同姓者作為契約"中人"是清代土地買賣契約中的一個重要特點(diǎn)。"中人"現(xiàn)象有著特有的法文化背景,民事領(lǐng)域內(nèi)國家制定法的讓位是民事立法背景,多元化的民事糾紛解決機(jī)制為民事司法背景,血緣與地緣相結(jié)合的鄉(xiāng)族共同體構(gòu)成社會背景。
[Abstract]:"Zhongren" is an important part of the contract civilization of the Chinese legal system and an important legal phenomenon in the land sale contract in the Qing Dynasty. In the land purchase and sale contract of the Qing Dynasty, almost all the contracts had the participation of "middle person" and played an important role in the contract. It is an important feature in the land sale contract of Qing Dynasty that the seller and the seller share the same surname as the person in the contract. The phenomenon of "Chinese people" has its own legal cultural background. The civil legislation background is the abdication of the state law in the civil field, and the diversified civil dispute resolution mechanism is the civil judicial background. The rural community, which combines blood and geography, forms the social background.
