【摘要】： 抗戰(zhàn)時期陜甘寧邊區(qū)的刑事法規(guī)是隨著新民主主義革命運動的發(fā)展并遵循著法制的發(fā)展規(guī)律而逐步產(chǎn)生、發(fā)展起來的�？箲�(zhàn)時期,陜甘寧邊區(qū)在對蘇區(qū)時期的刑事法規(guī)的繼承和發(fā)展的基礎(chǔ)上,根據(jù)邊區(qū)實際情況,借鑒國民黨政府法律的一些原則,建立了較為完整的體系,其無論是對鞏固根據(jù)地抗日民主政權(quán)還是擴大抗日民族統(tǒng)一戰(zhàn)線都起到了重要的作用。本文在吸收前人研究所取得成果的基礎(chǔ)上,對邊區(qū)刑事法規(guī)進行了較為全面、深入的探討和研究,并在此基礎(chǔ)上提出了幾點邊區(qū)刑事法規(guī)建設(shè)中值得當代借鑒之處。本文共分為三個部分： 在第一部分,首先介紹了邊區(qū)刑事法規(guī)的法律淵源,如邊區(qū)單行刑法條例,黨的路線、方針、政策,蘇區(qū)時期的刑事法規(guī),國民黨政府的刑法等；其次對邊區(qū)刑事法規(guī)建設(shè)的社會背景進行了簡要分析,其為全面認識和了解陜甘寧邊區(qū)刑事法規(guī)建設(shè)作了必要的鋪墊和介紹。 在第二部分,主要從立法指導思想、基本原則、罪名種類、刑罰制度等幾方面對邊區(qū)刑事法規(guī)的內(nèi)容進行了研究,概括總結(jié)出其特點,在大量借用前人研究成果的基礎(chǔ)上,試圖勾勒出陜甘寧邊區(qū)刑事法規(guī)的全貌,以求對抗戰(zhàn)時期邊區(qū)刑事法規(guī)所涉及的內(nèi)容有較為全面的了解,還歷史以本來面目。 在第三部分,對邊區(qū)刑事法規(guī)建設(shè)的作用進行了論述,得出結(jié)論：邊區(qū)刑事法規(guī)的建設(shè)取得了可喜的成績,不僅懲罰了犯罪,保障了邊區(qū)人民人權(quán)財權(quán)的安全,鞏固了邊區(qū)人民民主政權(quán),實現(xiàn)了邊區(qū)各階層人民的團結(jié),穩(wěn)定了邊區(qū)社會,還擴大與鞏固了邊區(qū)抗日民族統(tǒng)一戰(zhàn)線,滿足了取得抗戰(zhàn)勝利的要求,增強了與敵斗爭的力量,并為新中國的刑法建設(shè)奠定了基礎(chǔ)。邊區(qū)刑事法規(guī)建設(shè)中的許多經(jīng)驗也是值得我們今天借鑒的,如立法的現(xiàn)實性、寬嚴相濟、靈活適用刑法等。
[Abstract]:During the Anti-Japanese War, the criminal laws and regulations of the Shensi-Kansu-Ningsia Border region were gradually produced and developed along with the development of the New Democratic Revolutionary Movement and following the law of the development of the legal system. During the Anti-Japanese War, the Shensi-Kansu-Ningsia Border region, on the basis of the inheritance and development of the criminal laws and regulations of the Soviet region, and according to the actual situation of the Border region, drew lessons from some principles of the laws of the Kuomintang government and established a relatively complete system. It played an important role in consolidating the anti-Japanese democratic regime in the base area and expanding the anti-Japanese national United front. On the basis of absorbing the achievements of the previous studies, this paper makes a more comprehensive, in-depth discussion and study on the criminal laws and regulations of the Border region, and on this basis puts forward several points for reference in the construction of the criminal laws and regulations of the Border region. This paper is divided into three parts: In the first part, the author first introduces the legal sources of the criminal laws and regulations of the border region, such as the separate criminal law regulations of the border region, the party's line, principles, policies, the criminal laws and regulations of the Soviet region period, the criminal law of the Kuomintang government, and so on. Secondly, the paper briefly analyzes the social background of the construction of criminal laws and regulations in the border area, which makes a necessary foreshadowing and introduction for the comprehensive understanding and understanding of the construction of criminal laws and regulations in the Shensi-Kansu-Ningsia Border region. In the second part, mainly from the legislative guiding ideology, basic principles, types of charges, penalty system and other aspects of the border region criminal laws and regulations were studied, summed up its characteristics, on the basis of a large number of previous research results. This paper attempts to outline the overall picture of the criminal laws and regulations in the Shensi-Kansu-Ningsia Border region in order to have a more comprehensive understanding of the contents involved in the criminal laws and regulations of the Border region during the Anti-Japanese War and to return the history as it is. In the third part, the author discusses the function of the construction of the criminal laws and regulations in the Border region, and draws a conclusion that the construction of the criminal laws and regulations in the Border region has made gratifying achievements, which not only penalizes the crime, but also ensures the security of the people's human rights and financial rights in the Border region. It has consolidated the people's democratic regime in the Border region, realized the unity of the people of all strata in the Border region, stabilized the society of the Border region, expanded and consolidated the anti-Japanese national United front in the Border region, met the demand for victory in the War of Resistance against Japan, and strengthened the strength of the struggle against the enemy. And for the new China's criminal law construction laid the foundation. Many experiences in the construction of criminal laws and regulations in the Border region are also worthy of our reference today, such as the reality of legislation, leniency and severity, flexible application of criminal law and so on.
