【摘要】： 隨著網絡以及交通工具的高速發(fā)展,人們渴望大自然、回歸自然的思想愈來愈強,旅游觀念也在發(fā)生著變化,越來越多的旅游者特別是年輕人喜歡自助型的旅游方式而不是傳統(tǒng)的跟團旅游,加上探險旅游的刺激、驚險以及原生態(tài)的探險地更具有一定的吸引力,便產生了自助探險游這種新型的旅游方式。在自助探險游蓬勃發(fā)展的同時,由于此項活動本身具有很高的風險性,安全事故也頻繁發(fā)生。而目前,對于這種新型旅游方式,我國并沒有相關的法律法規(guī)予以規(guī)制,使得出現此種類型的法律糾紛后,法院面臨一個很大的難題,只能依據法理來判決,結果往往引起社會廣泛的爭議。在自助探險游中如何盡量避免安全事故的發(fā)生,事故發(fā)生后如何處理法律糾紛,都有待我們進一步的思考。本文通過典型案例引出目前自助探險游面臨的法律問題,并提出一些解決問題的對策。全文主要由以下幾個部分構成:第一部分,主要談自助探險游的概念、特征、發(fā)展現狀等等,從而介紹自助探險游這種旅游形式。第二部分,主要對自助探險游在全國引起很大反響的兩個案例的案情進行分析,引出自助探險游活動存在的法律問題,并對其爭議焦點進行探討并提出自己的觀點。第三部分,提出自助探險游主要存在的幾個方面的法律問題,包括自助探險游的相關準入制度缺失、法律責任不明確、相關保險保障制度的欠缺。第四部分,針對第三部分中自助探險游存在的法律問題提出相應的對策,包括建立自助探險游相關的準入制度、明確主體間的法律責任、完善相關的保險保障制度。作者希望本文能對我國自助探險游的健康發(fā)展產生積極的作用,從而推動我國旅游業(yè)的法制建設。
[Abstract]:With the rapid development of the network and transportation, people yearn for nature and return to nature more and more strongly. The concept of tourism is also changing. More and more tourists, especially young people, prefer self-help tourism rather than traditional group tours, plus the stimulation of adventure tourism, and adventure and original exploration places are more attractive to some extent. A new type of tourism, self-service adventure tour, emerged. With the rapid development of self-help adventure, safety accidents occur frequently because of its high risk. At present, there are no relevant laws and regulations to regulate this new type of tourism, which makes the court face a great problem after the emergence of this type of legal dispute, which can only be decided according to legal theory. The result is often widely debated in society. How to avoid the occurrence of safety accidents and how to deal with legal disputes in self-help expeditions need further consideration. This paper introduces the legal problems faced by self-help adventure tours through typical cases, and puts forward some countermeasures to solve the problems. This paper is mainly composed of the following parts: the first part, mainly discusses the concept, characteristics, development status of self-help adventure tour, so as to introduce the self-help adventure tour this form of tourism. In the second part, the author analyzes the cases of the two cases of self-help adventure tour which cause great repercussions in the whole country, leads to the legal problems existing in the self-help adventure tour, and probes into its controversial focus and puts forward its own point of view. In the third part, the author puts forward the main legal problems of self-help adventure tour, including the lack of relevant admission system, unclear legal responsibility and lack of relevant insurance guarantee system. In the fourth part, the author puts forward the corresponding countermeasures against the legal problems of self-help adventure tour in the third part, including establishing the admission system of self-help adventure tour, clarifying the legal responsibility between the subjects, and perfecting the relevant insurance guarantee system. The author hopes that this paper will play a positive role in the healthy development of self-help adventure tours in China, thus promoting the legal construction of tourism in China.
