中國(guó)古代親子法的倫理化及其現(xiàn)代價(jià)值

【摘要】: 古代中國(guó)是建立在小農(nóng)經(jīng)濟(jì)基礎(chǔ)上的家族倫理型社會(huì),家庭作為社會(huì)最基本的經(jīng)濟(jì)單位,肩負(fù)著維持農(nóng)業(yè)生產(chǎn)和維護(hù)社會(huì)穩(wěn)定的經(jīng)濟(jì)、政治雙重作用。因此,國(guó)家對(duì)如何調(diào)整家庭內(nèi)部的血親關(guān)系尤其是父與子之間的親子關(guān)系十分重視,以家父權(quán)為核心的中國(guó)古代親子法在整個(gè)封建法律體系中處于十分重要的地位。自周以降,禮法逐漸融合。“親親”、“尊尊”作為禮法的基本原則和精神被逐漸貫注到法律中,中國(guó)古代親子法走上了倫理化的道路。中國(guó)古代親子法通過倫理化強(qiáng)化了子女對(duì)于父母的孝道,并賦予父包括經(jīng)濟(jì)權(quán)、懲戒權(quán)在內(nèi)的諸多特權(quán),父母子女之間權(quán)利義務(wù)極不平等,實(shí)行同罪異罰。中國(guó)古代親子法的倫理化固然存在很多弊端,但其鑄就了中華民族贍養(yǎng)父母、敬老愛親的優(yōu)秀品格;促進(jìn)了子女責(zé)任意識(shí)的培養(yǎng);維護(hù)了家庭的和睦、社會(huì)的穩(wěn)定以及人際關(guān)系的和諧;體現(xiàn)了法律的人文關(guān)懷等。這些合理因素仍然有其重要的現(xiàn)代價(jià)值。 家庭是社會(huì)結(jié)構(gòu)的基本單位,然而當(dāng)前中國(guó)家庭中的親子關(guān)系正面臨嚴(yán)峻的挑戰(zhàn)。子女不孝敬父母的現(xiàn)象,子女自私自利、缺乏責(zé)任意識(shí)的現(xiàn)象,子女啃老等等家庭親子倫理扭曲的現(xiàn)象愈演愈烈。而針對(duì)這些現(xiàn)象,有必要弘揚(yáng)中國(guó)古代親子法倫理化中的注重親情維護(hù)、重視倫理親情、培育孝親精神以及踐行人倫道德等合理因素,以實(shí)現(xiàn)我國(guó)親子法的健康有序發(fā)展。
[Abstract]:Ancient China was a family ethical society based on small-scale peasant economy. As the most basic economic unit of the society, the family shouldered the economic and political functions of maintaining agricultural production and maintaining social stability. Therefore, the state attaches great importance to how to adjust the blood relations within the family, especially the parent-child relationship between the father and the son. The ancient Chinese parent-child law, with the power of the father as the core, plays a very important role in the whole feudal legal system. Since the Zhou Dynasty, ritual law has gradually merged. As the basic principle and spirit of etiquette law, "kiss" and "respect for respect" were gradually absorbed into the law, and the ancient Chinese parent-child law took the path of ethics. The ancient Chinese parent-child law strengthened the filial piety of the children to their parents through ethics, and endowed the father with many privileges, including economic rights and disciplinary powers. The rights and obligations between parents and children were very unequal, so they were punished for the same crimes and different crimes. Although there are many drawbacks in the ethicalization of parent-child law in ancient China, it has created the Chinese nation's excellent character of supporting parents, respecting the elderly and loving relatives; promoting the cultivation of the sense of responsibility of children; and safeguarding the harmony of the family. The stability of society and the harmony of interpersonal relationship embody the humanistic concern of law. These reasonable factors still have important modern value. Family is the basic unit of social structure, but the parent-child relationship in Chinese family is facing severe challenges. The phenomenon of children's disrespect for parents, selfishness of children, lack of sense of responsibility, children gnawing old and so on, the phenomenon of parents and children ethics distortion intensified. In order to realize the healthy and orderly development of parent-child law in China, it is necessary to carry forward the reasonable factors, such as the maintenance of kinship, the ethical kinship, the cultivation of filial piety and the practice of the morality of human relations in the physics and chemistry of parent-child Fallon in ancient China.
