【摘要】： 本文的研究對(duì)象是兩漢時(shí)期的“春秋決獄”案例。作者首先通過(guò)對(duì)張家山漢簡(jiǎn)《奏讞書(shū)》的細(xì)致分析,得出“春秋決獄”的“原心定罪”之風(fēng)源自東周(春秋)時(shí)期的觀點(diǎn)；其次對(duì)漢代“經(jīng)義至上”的司法環(huán)境進(jìn)行考察,試圖闡明儒家思想與漢律之關(guān)系,進(jìn)而較清晰的展現(xiàn)兩漢時(shí)期是在何種情形下進(jìn)行“春秋決獄”的；最后對(duì)兩漢時(shí)期的“春秋決獄”典型案例進(jìn)行分析,得出“春秋決獄”實(shí)為矯漢律之酷的慎刑做法之結(jié)論。
[Abstract]:The research object of this paper is the case of the Spring and Autumn period in the Han Dynasty. First of all, through the careful analysis of Zhang Jiashan's Han bamboo slips, the author draws a conclusion that the "original conviction" of "Chunqiu Jail" originated from the Eastern Zhou Dynasty (the Spring and Autumn period), and then inspected the judicial environment of the Han Dynasty "the Superior of the Classics and righteousness". This paper attempts to clarify the relationship between Confucianism and the laws of the Han Dynasty, and then shows clearly the circumstances under which the "Chunqiu Jail" was carried out during the Han Dynasty, and finally analyzes the typical cases of the "Chunqiu Jail" during the Han Dynasty. It comes to the conclusion that Chunqiu Jail is the coolest practice of regulating the law of Han Dynasty.
