【摘要】： 20世紀(jì)中葉以來,人類在享受技術(shù)進(jìn)步帶來的經(jīng)濟(jì)成果的同時(shí),也為之付出了環(huán)境污染、資源枯竭、生態(tài)失衡的巨大代價(jià),全球性生態(tài)危機(jī)日益嚴(yán)重。人類不得不對現(xiàn)有的發(fā)展模式進(jìn)行反思,在此基礎(chǔ)上,可持續(xù)發(fā)展思想應(yīng)運(yùn)而生。就可持續(xù)發(fā)展理念而言,其關(guān)乎全人類未來的發(fā)展場景,具有豐富深刻的理論意蘊(yùn)和長遠(yuǎn)的理論影響。自20世紀(jì)80年代中期以來,中國法律的發(fā)展在理論和實(shí)踐上都受到可持續(xù)發(fā)展的強(qiáng)烈影響,法律價(jià)值作為法律的核心理念之一,其也隨著可持續(xù)發(fā)展理論研究的逐步深入而發(fā)生一些新的重大變化。就法律價(jià)值而言,其必須關(guān)注特定社會(huì)結(jié)構(gòu)和經(jīng)濟(jì)結(jié)構(gòu)的基本價(jià)值�？沙掷m(xù)發(fā)展帶給法律價(jià)值的是一場變革,但其實(shí)施并不是一蹴而就的事情,只有法律價(jià)值對可持續(xù)發(fā)展做出積極的回應(yīng),才能夠給法律制度的實(shí)踐層面帶來積極的改變。 可持續(xù)發(fā)展思想正對傳統(tǒng)的法律價(jià)值產(chǎn)生影響,正不斷的賦予傳統(tǒng)的法律價(jià)值新的內(nèi)涵。本文首先從法律價(jià)值入手,探討了傳統(tǒng)法律價(jià)值的屬性、結(jié)構(gòu)和體系,并在簡要介紹可持續(xù)發(fā)展思想的基礎(chǔ)上,著重分析了可持續(xù)發(fā)展思想給法律價(jià)值帶來的影響。從國內(nèi)對可持續(xù)發(fā)展理論的研究和實(shí)施的方案中,不難看出其對整個(gè)法律體系的沖擊和影響,并且可以預(yù)見這種影響對法律價(jià)值研究的廣度、深度、前景和后果都將是空前的。
[Abstract]:Since the middle of the 20th century, human beings have paid the huge cost of environmental pollution, resource depletion and ecological imbalance while enjoying the economic achievements brought by technological progress. The global ecological crisis is becoming more and more serious. Human beings have to reflect on the existing development model, on the basis of which, the idea of sustainable development emerged as the times require. As far as the concept of sustainable development is concerned, it is related to the future development scenario of all mankind, and has rich and profound theoretical implications and long-term theoretical influence. Since the mid-1980s, the development of Chinese law has been strongly influenced by the sustainable development both in theory and practice. The value of law is one of the core concepts of law. With the development of the theory of sustainable development, some new and important changes have taken place. As far as legal value is concerned, it must pay attention to the basic value of specific social structure and economic structure. Sustainable development brings a change to the legal value, but its implementation is not accomplished overnight. Only when the legal value makes a positive response to the sustainable development, can it bring positive changes to the practice of the legal system. The thought of sustainable development is exerting an influence on the traditional legal value and endowing the new connotation of the traditional legal value. This paper begins with the legal value, discusses the attribute, structure and system of the traditional legal value, and on the basis of the brief introduction of the sustainable development thought, emphatically analyzes the influence of the sustainable development thought on the legal value. From the domestic research and implementation of sustainable development theory, it is not difficult to see its impact and impact on the entire legal system, and it can be predicted that this impact on the breadth, depth, prospects and consequences of the study of legal value will be unprecedented.
