【摘要】： 有關(guān)法律移植和法律現(xiàn)代化的討論在當前法學研究中占有特殊的地位。在這些研究之中有關(guān)日本的法制近代化問題受到了極大的關(guān)注,因為日本法制近代化的實現(xiàn)不僅對于日本意義非凡,也在很大程度上影響了中國、東亞的歷史發(fā)展進程。這方面的著作、論文成果頗豐,但這并不意味著我們對日本法制近代化的研究就可以裹足不前了。因此,本論文集中研究日本明治時期的法制近代化。 論文第一章是對日本法制近代化過程的整體介紹。首先分析日本古代法和近代法的狀況和特征,展現(xiàn)日本法制從中國風向西洋風的轉(zhuǎn)變;其次對日本明治維新時期的法制建設(shè)進行具體介紹,重點圍繞憲法、民法典和刑法典。 第二章是對日本法制近代化的主要特征的總結(jié),具體包括先刑事領(lǐng)域再民事領(lǐng)域最后憲政領(lǐng)域的先易后難,對西方國家各有所取的最優(yōu)化選擇,先激進后保守的適時調(diào)整等三個方面。 第三章詳細剖析日本法制近代化得以成功的原因。首先,任何社會的法制都不能孤立存在,日本法制的近代化作為日本整個社會近代化進程的一個組成部分,其成功是依托了日本獨特的封建社會結(jié)構(gòu)、幕藩體制的結(jié)果,這種結(jié)構(gòu)和體制是日本法制近代化的可能性條件;其次,明治政府改革者本身所具備的危機意識和開放的學習心態(tài)對法律移植的推動是日本法制近代化的必要性條件;再次,日本法制近代化的改革者和推動者由武士、志士、政治改革家構(gòu)成,他們是從幕府體制中轉(zhuǎn)化而來,有著堅定的信念、務(wù)實的作風,這些構(gòu)成了日本法制近代化不可或缺的主體性條件。沒有這些條件共同發(fā)揮作用就不會有日本法制的近代化。這無論對于今天我國的法制現(xiàn)代化還是國家的可持續(xù)發(fā)展、和諧社會的建設(shè)都具有重大的啟示意義。
[Abstract]:The discussion about law transplantation and legal modernization occupies a special position in the current legal research. Among these studies, great attention has been paid to the modernization of Japan's legal system, because the realization of Japanese legal modernization is not only of great significance to Japan, but also greatly affects the historical development process of China and East Asia. There are plenty of books and papers, but that doesn't mean that our research on the modernization of Japan's legal system can be held back. Therefore, this collection studies the modernization of Japanese legal system in Meiji period. The first chapter introduces the process of Japanese legal modernization. Firstly, it analyzes the status and characteristics of Japanese ancient law and modern law, and shows the change of Japanese legal system from Chinese to Western style. Secondly, it introduces the construction of Japanese legal system during the Meiji Restoration period, focusing on the constitution, civil code and criminal code. The second chapter is a summary of the main features of Japanese legal modernization, including the first criminal field and civil field, the final constitutional field after difficult, the western countries have their own optimal choice. First radical and then conservative timely adjustment and so on three aspects. The third chapter analyzes the reasons for the success of Japanese legal modernization in detail. First of all, the legal system of any society cannot exist in isolation. As an integral part of the process of modernization of the entire Japanese society, the modernization of the Japanese legal system is the result of relying on Japan's unique feudal social structure and the curtain vassal system. This structure and system are the possible conditions for the modernization of the Japanese legal system. Secondly, the crisis consciousness and open learning mentality of the Meiji government reformers themselves are the necessary conditions for the modernization of the Japanese legal system. The reformers and promoters of Japan's modernization of the legal system are made up of samurai, idealists, and political reformers who have been transformed from the shogunate system and have a firm conviction and pragmatic style. These constitute the indispensable subjective conditions for the modernization of Japanese legal system. Without these conditions, there would be no modernization of the Japanese legal system. This is of great significance to the construction of a harmonious society, not only for the modernization of the legal system but also for the sustainable development of our country.
