中國(guó)法學(xué)教育之現(xiàn)狀、問(wèn)題與發(fā)展進(jìn)路

【摘要】: 法立,則人存政不息,法治興,則人安政不衰。法學(xué)教育之存乎,則法治益興,國(guó)家益盛?梢,法學(xué)教育關(guān)乎法治立與興,國(guó)家安與盛。在法治建設(shè)不斷開展和深入,法律信仰逐漸萌生的新時(shí)代背景下,法學(xué)教育成為了這整個(gè)過(guò)程的關(guān)鍵詞之一。我國(guó)法學(xué)教育發(fā)展至今,毋庸置疑,已經(jīng)在諸如辦學(xué)規(guī)模,培養(yǎng)模式,教學(xué)方法和課程設(shè)置等方面取得了巨大的突破性發(fā)展。在肯定成績(jī)的同時(shí),筆者根據(jù)法學(xué)專業(yè)的本身特點(diǎn),結(jié)合當(dāng)今時(shí)代特征,從我國(guó)法學(xué)教育的現(xiàn)狀出發(fā),指出了其存在的諸多癥結(jié)和頑疾,并在此基礎(chǔ)上進(jìn)行具體的問(wèn)題分析,給出了解決問(wèn)題的思路和方法。所以,本文的基本框架如下:首先,明確時(shí)代背景以及在此背景下,法學(xué)教育所承擔(dān)的時(shí)代使命:加快開創(chuàng)和發(fā)展權(quán)利文化,強(qiáng)調(diào)并建立對(duì)法律的信仰,努力增強(qiáng)實(shí)踐技能,加強(qiáng)綜合素質(zhì)教育;其次,從模擬法庭、法律診所、單位實(shí)習(xí)和案例教學(xué)等基本模式入手,客觀地闡述我國(guó)法學(xué)教育培養(yǎng)模式的現(xiàn)狀,肯定成績(jī),找出主要問(wèn)題之所在:與法律職業(yè)相脫節(jié),國(guó)際競(jìng)爭(zhēng)力不足,辦學(xué)層次不合理以及就業(yè)前景不明朗等,并對(duì)各個(gè)主要問(wèn)題進(jìn)行深入的分析,指出造成的原因;最后,則是基于前部分對(duì)問(wèn)題的剖析,對(duì)我國(guó)法學(xué)教育未來(lái)的發(fā)展進(jìn)路提出個(gè)人觀點(diǎn):以法律職業(yè)為導(dǎo)向,縮小并提高辦學(xué)層次,走精英教育之路;完善課程設(shè)置,尤其在法學(xué)專業(yè)的課程表里增加倫理學(xué)、政治學(xué)和歷史學(xué)等相關(guān)重要課程,以培養(yǎng)學(xué)生相應(yīng)的素質(zhì)和技能;建立多部門聯(lián)合培養(yǎng)模式,學(xué)校與學(xué)校,學(xué)校與政府以及與其他相關(guān)單位,如與司法機(jī)關(guān)、律協(xié)和律所等加強(qiáng)交流與合作,使法學(xué)教育真正走上產(chǎn)學(xué)研相結(jié)合的道路,以實(shí)現(xiàn)理論教育和實(shí)踐鍛煉的充分結(jié)合,實(shí)現(xiàn)其與法律職業(yè)的真正接軌。通過(guò)本文的架構(gòu)和分析,一方面使得整個(gè)法學(xué)教育的現(xiàn)狀一目了然,另一方面使得現(xiàn)今沉寂的法學(xué)教育現(xiàn)狀所掩蓋的各種弊端暴露無(wú)遺。明了現(xiàn)狀,揭露問(wèn)題,有的放矢,才能真正解決問(wèn)題,消滅頑疾,新時(shí)代中國(guó)法學(xué)教育才能最終走上持續(xù)穩(wěn)定的健康之道,法治建設(shè)也因此能更好更快地得到發(fā)展。
[Abstract]:Law, the people keep government, the rule of law, people's peace and stability. The existence of legal education, the rule of law is more prosperous, the country is prosperous. It can be seen that legal education is related to the establishment and prosperity of the rule of law, the national security and prosperity. Under the background of the new era when the construction of the rule of law is being carried out and the legal belief is gradually springing up, law education has become one of the key words in the whole process. With the development of law education in China, there is no doubt that great breakthrough has been made in such aspects as the scale of running a school, the training model, the teaching method and the curriculum. At the same time, according to the characteristics of the major of law and the characteristics of the times, the author points out many sticking points and persistent problems in the present situation of law education in our country, and then analyzes the specific problems on this basis. The ideas and methods to solve the problem are given. Therefore, the basic framework of this paper is as follows: first, clear the background of the times and in this context, legal education undertakes the mission of the times: speed up the creation and development of the culture of rights, emphasize and establish the belief in the law, and strive to enhance practical skills. Secondly, starting with the basic models of mock court, law clinic, unit practice and case teaching, this paper objectively expounds the present situation of the training mode of law education in our country, and affirms its achievements. Find out where the main problems are: disjointed with the legal profession, insufficient international competitiveness, unreasonable level of running a school and uncertain employment prospects, and make an in-depth analysis of each major problem, pointing out the causes; finally, On the basis of the analysis of the problems in the first part, the author puts forward some personal views on the future development of legal education in China: taking the legal profession as the guide, narrowing and improving the level of running a school, taking the path of elite education, perfecting the curriculum, In particular, major courses such as ethics, political science and history should be added to the curriculum of the law major to develop students' corresponding qualities and skills, and to establish a multi-sector joint training model for schools and schools. Schools and governments, as well as other relevant units, such as the judiciary, law associations and law firms, to strengthen exchanges and cooperation, so that law education really on the road of integration of production, learning and research, in order to achieve the full combination of theoretical education and practical exercise, To achieve its true integration with the legal profession. Through the structure and analysis of this paper, on the one hand, it makes the present situation of the whole law education clear at a glance, on the other hand, it exposes all kinds of defects covered by the silent present situation of law education. Only by understanding the present situation, exposing the problems and aiming at them, can we really solve the problems and eliminate the stubborn diseases. Only in the new era can China's legal education finally embark on a healthy and sustainable way, and thus the construction of the rule of law can be developed better and faster.
