【摘要】：在中國的傳統(tǒng)法律中，“慎刑”理論源遠流長，“民惟邦本”觀念是“慎刑”傳統(tǒng)在立法與司法的平衡點�！吧餍獭狈磳嵝獭E刑，堅持明德慎罰。當前我國實施的“寬嚴相濟”的刑事政策與傳統(tǒng)法中“慎刑”的理論具有相通性�！吧餍獭钡默F代價值在于：注重司法和諧；實踐“寬嚴相濟”；推進獄政司法�！吧餍獭笔菢嫿ê椭C社會的理論基礎，，“寬嚴相濟”的刑事政策是對“慎刑”的借鑒，獄政司法的人文關照是“慎刑”當代司法人性化的重要價值體現。
[Abstract]:In Chinese traditional law, the theory of careful punishment has a long history. "careful punishment" against torture, excessive punishment, adhere to a prudent punishment. The current criminal policy of combining leniency and severity with the theory of "careful punishment" in traditional law is of the same nature. The modern value of "careful punishment" lies in paying attention to judicial harmony, practicing "combining leniency and strict punishment" and promoting the administration of justice. "careful punishment" is the theoretical basis of constructing a harmonious society, the criminal policy of "combining leniency and severity with justice" is the reference to "careful punishment", and the humanistic care of prison administration justice is the important value of "careful punishment" contemporary judicial humanization.
