阿奎那自然法的當(dāng)代解讀

【摘要】: 本文是一篇簡(jiǎn)述阿奎那自然法在當(dāng)代發(fā)展的短文。風(fēng)格處于敘述和議論之間。主要論題在于,阿奎那在《神法大全》中創(chuàng)發(fā)了一種自然法思想,這種自然法需要置于其對(duì)法律本質(zhì)的論述以及法律種類(lèi)的考察中進(jìn)行理解。在上個(gè)世紀(jì),隨著新托馬斯主義的興起,阿奎那的理論體系重新贏得尊嚴(yán),受到愈來(lái)愈多的學(xué)者的青睞。當(dāng)代在法學(xué)研究中出現(xiàn)了一些以阿奎那自然法為論題的研究。這些人都試圖以阿奎那的教義建立自己的自然法論。然而,這些理論中哪些是真正堅(jiān)持了阿奎那自然法思想的?頗具吊詭意味的是,旗幟鮮明地宣稱(chēng)是托馬斯主義者的卻并未貫徹阿奎那自然法思想,反而是“新”自然法理論家在試圖回避這一標(biāo)簽的情況下堅(jiān)持著阿奎那的立場(chǎng)。爭(zhēng)論由此產(chǎn)生。表面看這不過(guò)是對(duì)阿奎那文本的解釋之爭(zhēng),其實(shí)從更深層來(lái)觀(guān)察,其中涉及天主教教義正統(tǒng)性問(wèn)題。本文重點(diǎn)展示了當(dāng)代幾位自然法論者以托馬斯主義者的立場(chǎng)闡釋的自然法理論以及他們對(duì)“新”自然法的批判,并敘述了“新”自然法理論家的回應(yīng),然后根據(jù)阿奎那的文本對(duì)這些回應(yīng)做了簡(jiǎn)短評(píng)論。 全文共分六個(gè)部分: 引言部分交代了文章的研究對(duì)象,意義以及研究思路。 主體部分的第一章是對(duì)阿奎那自然法載體的《論法律》中基本自然法問(wèn)題的解讀。指出自然法是與對(duì)法律本質(zhì)的理解密切相關(guān)的,以及自然法在阿奎那法律大全中的獨(dú)特地位。 第二章著重介紹了當(dāng)代幾位托馬斯主義者以及“新”自然法理論家對(duì)阿奎那自然法基本問(wèn)題的闡述,這一部分是以大致相同的問(wèn)題展開(kāi)論述的。 第三章承接上一章主要總結(jié)了這些對(duì)阿奎那自然法闡釋的主義分歧之處。以及其他論者對(duì)“新”自然法的“圍攻”之勢(shì)。 第四章主要論述了“新”自然法對(duì)這些批判的回應(yīng),并通過(guò)回到阿奎那的文本揭示“新”自然法的優(yōu)勢(shì)所在。 結(jié)論部分是本人對(duì)阿奎那自然法的一點(diǎn)看法,同時(shí)也表達(dá)了對(duì)“新”自然法信條的贊同。
[Abstract]:This article is a brief description of Aquinas natural law in the contemporary development. Style lies between narration and argumentation. The main point of this thesis is that Aquinas created a kind of natural law thought in the book of God's Law, which needs to be understood in his exposition of the essence of law and in the investigation of the types of law. In the last century, with the rise of New Thomas Doctrine, Aquinas's theory system gained dignity again and was favored by more and more scholars. There are some studies on Aquinas natural law in the contemporary legal research. These people tried to establish their own natural law theory by the doctrine of Aquinas. However, which of these theories really adhere to Aquinas' natural law ideas? Paradoxically, it is the "new" natural law theorist who insists on Aquinas's position when he tries to evade the label, but does not carry out Aquinas' natural law thought in a clear-cut way that is claimed by the Thomas Doctrine. The argument ensued. On the face of it, this is merely a dispute over the interpretation of Aquinas, which, in fact, concerns the orthodoxy of Catholicism. This paper focuses on the theory of natural law interpreted by some contemporary naturalists and their critique of the "new" natural law, and describes the response of the "new" natural law theorists. Then, according to Aquinas text, these responses were briefly commented upon. The full text is divided into six parts: The introduction describes the research object, significance and research ideas of the article. The first chapter of the main part is the interpretation of the basic natural law in Aquinas' Natural Law Carrier. It is pointed out that natural law is closely related to the understanding of the essence of law and its unique position in Aquinas law. The second chapter focuses on the elaboration of the basic problems of Aquinas natural law by several contemporary Thomas idealists and the "new" natural law theorists. The third chapter summarizes the differences in the interpretation of Aquinas' natural law. And other commentators on the "new" natural law of the "siege" trend. The fourth chapter mainly discusses the response of the "new" natural law to these criticisms, and reveals the advantages of the "new" natural law by returning to Aquinas. The conclusion part is my opinion on Aquinas natural law, and also expresses my approval of the "new" natural law creed.
