【摘要】： 利益衡量方法作為一種特殊的法律解釋方法,從產(chǎn)生后就在理論界和實(shí)務(wù)界產(chǎn)生了極大地影響。本文在法律方法的視角下,從研究現(xiàn)狀、概念特征、必要性、具體應(yīng)用及利益衡量面對(duì)的困境及解決方法等角度出發(fā),對(duì)利益衡量各方面作了詳盡的論述;同時(shí)因?yàn)槔婧饬康膫�(gè)案性、先決性的特點(diǎn),本文還以一些典型具體的案件為例,運(yùn)用利益衡量的方法對(duì)其上述內(nèi)容進(jìn)行了探討、分析,試圖通過案件中的現(xiàn)實(shí)利益的權(quán)衡和取舍,來獲得利益衡量適用時(shí)的具體規(guī)則。當(dāng)然,利益衡量還有自身的局限性,需要進(jìn)一步規(guī)范,限制法官的恣意和濫用。 本文共分為三部分,著重探討利益衡量的基本原則和利益衡量的實(shí)證分析。前兩部分主要是理論的研究與概述,著重分析了利益衡量的研究現(xiàn)及其基本理論,主要是為后面的重點(diǎn)內(nèi)容做鋪墊。第三部分是本文的重點(diǎn),此部分借用大量的案例來分析利益衡量適用的具體原則及過程。同時(shí)也分析了利益衡量在審判實(shí)踐中遇到的難題及解決方法。
[Abstract]:As a special method of legal interpretation, the method of interest measurement has had a great influence on the theoretical and practical circles since it came into being. From the point of view of legal method, from the point of view of research status, concept characteristics, necessity, concrete application, dilemma and solution of interest measurement, this paper makes a detailed exposition on various aspects of interest measurement. At the same time, because of the case of interest measurement, the characteristics of preliminary, this paper also takes some typical and specific cases as an example, using the method of interest measurement to discuss and analyze the above contents. This paper attempts to obtain the specific rules of interest measurement and application by weighing and choosing realistic interests in a case. Of course, interest measurement has its own limitations, which need to be further regulated to limit the arbitrariness and abuse of judges. This paper is divided into three parts, focusing on the basic principles of interest measurement and empirical analysis of interest measurement. The first two parts are mainly the research and summary of the theory, focusing on the analysis of the interest measurement research and its basic theory, mainly for the later key content. The third part is the focus of this paper, this part uses a large number of cases to analyze the specific principles and processes of interest measurement. At the same time, it also analyzes the problems and solutions of interest measurement in trial practice.
