【摘要】：在強(qiáng)調(diào)市場(chǎng)在資源配置中發(fā)揮決定性作用、保障社會(huì)自治和個(gè)人權(quán)利的時(shí)代背景下,對(duì)當(dāng)代中國(guó)既有的法律意識(shí)形態(tài)進(jìn)行創(chuàng)新成為歷史必然。通過(guò)梳理國(guó)家治理體系現(xiàn)代化過(guò)程中出現(xiàn)的主要價(jià)值觀和思考方式,從中提煉出關(guān)于秩序正統(tǒng)性的若干種最基本的理論主張:自然法和社會(huì)契約、文化傳統(tǒng)或民族精神、社群主義性質(zhì)的公共哲學(xué)以及科學(xué)的歷史唯物論,并從不同的視角進(jìn)行解讀,現(xiàn)代法治精神存在內(nèi)在矛盾。某種具有政府、市場(chǎng)、社會(huì)三元結(jié)構(gòu)的國(guó)家觀應(yīng)該成為未來(lái)中國(guó)的法律意識(shí)形態(tài),公正程序則構(gòu)成整合的制度基礎(chǔ)。
[Abstract]:Under the background of emphasizing that the market plays a decisive role in the allocation of resources and safeguarding social autonomy and individual rights, it has become a historical necessity to innovate the existing legal ideology in contemporary China. By combing the main values and ways of thinking in the process of modernization of the national governance system, several basic theories about the orthodoxy of order are abstracted from them: natural law and social contract, cultural tradition or national spirit. Public philosophy of communitarianism and historical materialism of science are interpreted from different angles, and there are inherent contradictions in the spirit of modern rule of law. A kind of state view with government, market and social ternary structure should be the legal ideology of China in the future, and the fair procedure should form the system foundation of integration.
