【摘要】：21世紀(jì)中國(guó)法治的發(fā)展,取決于中國(guó)私權(quán)的整體進(jìn)步與發(fā)展。私權(quán)進(jìn)則法治興,私權(quán)滯則法治衰。本文以中國(guó)特色社會(huì)主義為前提,圍繞法治建設(shè)與私權(quán)保護(hù)的關(guān)系展開分析論證。 第一部分分析論證了私權(quán)保護(hù)是我國(guó)法治建設(shè)的重點(diǎn)。文章從基本概念的界定入手,分析了法治和私權(quán)的內(nèi)涵與外延。從歷史維度剖析了以“私權(quán)保護(hù)”為基本線索的西方法治歷程。一方面肯定了以私權(quán)為核心的西方法治在客觀上促進(jìn)了資本主義商品經(jīng)濟(jì)的高速發(fā)展,創(chuàng)造了舉世矚目的現(xiàn)代政治文明與經(jīng)濟(jì)文明；另一方面,指出了以資本主義私有制為基礎(chǔ)的西方法治在私權(quán)實(shí)現(xiàn)方面的虛假性,明確了只有社會(huì)主義制度與法治結(jié)合,才能真正實(shí)現(xiàn)大多數(shù)人的權(quán)利。第二部分對(duì)我國(guó)私權(quán)的變遷進(jìn)行了歷史梳理,并對(duì)我國(guó)當(dāng)前的私權(quán)現(xiàn)狀進(jìn)行了深入分析。第三部分關(guān)于如何圍繞“中國(guó)特色社會(huì)主義”實(shí)現(xiàn)我國(guó)的法治目標(biāo)與私權(quán)保護(hù),筆者提出了幾點(diǎn)建議。 中國(guó)特色社會(huì)主義法治建設(shè)與私權(quán)保護(hù)必須以中國(guó)特色社會(huì)主義理論為指導(dǎo),保持正確的政治方向。人的權(quán)利反映著人在社會(huì)中的地位,最終決定于社會(huì)的經(jīng)濟(jì)結(jié)構(gòu),要解決人的權(quán)利問(wèn)題,必須解決社會(huì)制度問(wèn)題。只有在中國(guó)特色社會(huì)主義政治制度的框架下,中國(guó)特色社會(huì)主義法治才能得以長(zhǎng)足發(fā)展,廣人民群眾的個(gè)體權(quán)利才能得到真正實(shí)現(xiàn)。
[Abstract]:The development of the rule of law in China in the twenty-first Century depends on the overall progress and development of Chinese private rights. Private rights advance by the rule of law and the rule of law decline. This article, based on socialism with Chinese characteristics, analyzes the relationship between the construction of the rule of law and the protection of private rights.
The first part analyses and demonstrates that the protection of private rights is the key point of the construction of the rule of law in China. From the definition of the basic concepts, the article analyzes the connotation and extension of the rule of law and private rights. From the historical dimension, it analyzes the western rule of law with the basic clue of "protecting private rights". On the one hand, the western rule of law, with the core of private rights as the core, is objectively promoted. The rapid development of capitalist commodity economy has created the modern political civilization and economic civilization of the world. On the other hand, it points out the falsehood in the realization of private rights in the western rule of law based on capitalist private ownership. It is clear that only the combination of the socialist system and the rule of law can truly realize the rights of most people. The second part makes a historical review of the change of private rights in China, and analyses the current status of private rights in China. The third part puts forward some suggestions on how to achieve the goal of the rule of law and the protection of private rights around the "socialism with Chinese characteristics".
The construction of the rule of law and the protection of private rights of socialism with Chinese characteristics must be guided by the theory of socialism with Chinese characteristics and maintain a correct political direction. Human rights reflect the status of people in the society, ultimately determine the social economic structure and solve the problem of human rights, and must solve the social system problems. Under the framework of the political system, the rule of law of socialism with Chinese characteristics can be greatly developed, and the individual rights of the masses can be truly realized.
