【摘要】：受儒家孝義觀(guān)念、傳統(tǒng)地權(quán)觀(guān)念和風(fēng)水習(xí)俗等影響,清代的土地契約中往往會(huì)有"賣(mài)地留墳"的習(xí)慣性約定。在傳統(tǒng)中國(guó)人的心目中,墳地具有非常特殊的功能和意義,無(wú)論是清政府制定的國(guó)家法還是民間社會(huì)的習(xí)慣法均有"賣(mài)地留墳"的相關(guān)規(guī)定。在清代的地權(quán)爭(zhēng)訟中,緣于"賣(mài)地留墳"而引發(fā)的糾紛不在少數(shù),官府對(duì)于"賣(mài)地留墳"引發(fā)的爭(zhēng)訟極為重視。由此可見(jiàn),"賣(mài)地留墳"習(xí)俗對(duì)于中國(guó)傳統(tǒng)社會(huì)土地秩序的形成有著至關(guān)重要的影響。儒家倫理觀(guān)念依然遺存于今天的民間社會(huì),在構(gòu)建新型的土地秩序中,"賣(mài)地留墳"習(xí)俗的影響仍舊不容忽視。
[Abstract]:Influenced by the Confucian concept of filial piety, the traditional concept of land rights and the customs of feng shui, the land contract in Qing Dynasty often had the habit of "selling land and leaving graves". In the eyes of the traditional Chinese, the graveyard has a very special function and significance. Whether it is the state law enacted by the Qing government or the customary law of the civil society, it has the relevant provisions of "selling the land and leaving the grave". In the litigation of land rights in Qing Dynasty, there were not a few disputes caused by "making graves by selling land", and the government attached great importance to the disputes caused by "making graves by selling land". It can be seen that the custom of "selling and leaving graves" has a vital influence on the formation of land order in Chinese traditional society. The Confucian ethics still remains in today's civil society. In the construction of a new land order, the influence of the custom of "selling land and leaving graves" can not be ignored.
