【摘要】:百余年來,無數(shù)仁人志士為憲政思想及實踐而奮力前行。法學前輩們篳路藍縷,為國人開拓了實踐憲政的良好開端。而今,我們欣慰的看到,憲政理念已經漸漸融入人們的生活各方面和全過程——中國夢,即自由夢、憲政夢。 王寵惠是推動中國法制近代化和憲政化的法學前輩之一。本文著重圍繞王寵惠的憲法學思想展開,論述了王寵惠對中國法制的推動作用,以及他憲政思想的具體內容和實踐狀況。 在引論部分,著者主要從三個層面分析了研究王寵惠憲政思想的意義,即憲政人物層面、民國法學家層面和個人層面。另外,著者搜集國內相關論文,匯總了有關王寵惠法制思想及實踐的研究現(xiàn)狀。 在第二部分,著者著重闡釋了王寵惠憲政思想形成的社會背景和歷史淵源。準確把握一個人憲政思想的誕生環(huán)境有助于我們進一步了解其憲政思想的成因和內容。著者認為,在民初時期,軍閥威權統(tǒng)治、法律地位虛化、立憲思潮豐富且沖蕩激烈的社會狀況極大的左右了后來王寵惠憲政思想的形成和實踐。另外,王寵惠憲政思想的形成并非突兀的憑空降落過程,而是一個漸進的、繼承的過程,在這個過程中,孟德斯鳩的三權分立思想、孫中山的五權憲法思想以及胡適的自由主義思想都發(fā)揮了重大作用。 文章的第三部分主要介紹王寵惠憲政思想的內容。這一部分的展開主要以王寵惠憲法著作為核心分析文本,著者認為王寵惠憲政思想可以總結為四個方面的內容,即以制定良憲為理想的憲法體系設計、以尊崇法統(tǒng)為路徑的積極護憲主張、以發(fā)揚民權為核心的憲政制度建設和以司法改革為入口的憲政體制改良。 在第四部分中,著者展開了對王寵惠憲政思想的評價。王寵惠的一生充滿了關于“道路”和“主義”的各種矛盾,例如,在學術和政治之間的變奏、在司法獨立和司法黨化之間的變奏、在移植西方法制和重視本土傳統(tǒng)文化之間的變奏。著者主張以辯證的、歷史的眼光來看待王寵惠的憲政思想及實踐。
[Abstract]:For more than a hundred years, countless people with lofty ideals have worked hard for constitutional thought and practice. The forefathers of law have developed a good beginning of practicing constitutionalism for Chinese people. Now, we are gratified to see that the concept of constitutionalism has gradually integrated into all aspects of people's life and the whole process-Chinese Dream, that is, the dream of freedom, constitutional dream. Wang Daohui is one of the legal predecessors who promoted the modernization and constitutionalism of China's legal system. This paper focuses on Wang Daohui's thought of constitutional law, and discusses Wang's role in promoting Chinese legal system, as well as the concrete content and practice of his constitutional thought. In the introduction part, the author mainly analyzes the significance of the study of Wang's constitutional thought from three aspects, namely, the constitutional figure level, the Republican jurist level and the personal level. In addition, the author collects relevant papers and summarizes the research status of Wang Daohui's legal thought and practice. In the second part, the author explains the social background and historical origin of Wang Daohui's constitutional thought. An accurate understanding of the birth environment of a person's constitutional thought is helpful for us to further understand the causes and contents of his constitutional thought. The author believes that in the early period of the Republic of China, the formation and practice of Wang Daohui's constitutional thought were influenced by the authoritarian rule of warlords, the vanity of legal status and the rich and violent social conditions of constitutionalism. In addition, the formation of Wang Daohui's constitutional thought was not a sudden process of falling out of thin air, but a gradual, inherited process. In this process, Montesquieu's idea of separation of powers, Sun Zhongshan's five-power constitutional thought and Hu Shi's liberalism thought all played an important role. The third part of the article mainly introduces the content of Wang Daohui's constitutional thought. The author thinks that Wang Daohui's constitutional thought can be summed up in four aspects, that is, to make a good constitution as the ideal constitutional system design. The idea of protecting constitutionalism actively by respecting legal system, building constitutional system with developing civil rights as the core and improving constitutional system with judicial reform as its entrance. In the fourth part, the author evaluates Wang Daohui's constitutional thought. Wang's life was full of contradictions about "path" and "doctrine", such as variations between scholarship and politics, between judicial independence and judicial partisanship. The variation between transplanting western legal system and attaching importance to local traditional culture. The author advocates a dialectical and historical view of Wang's constitutional thought and practice.
