法治實(shí)踐過(guò)程中的道德基礎(chǔ)分析

【摘要】: 人類社會(huì)的調(diào)整規(guī)范體系的發(fā)展過(guò)程歷經(jīng)了宗教、倫理道德、風(fēng)俗習(xí)慣和法律混合的時(shí)期。隨著現(xiàn)代化發(fā)展的進(jìn)程,道德與法律逐漸的分離開(kāi)來(lái),各有其相對(duì)獨(dú)立的領(lǐng)域。在現(xiàn)代社會(huì)中,與法律相比,曾作為社會(huì)主要調(diào)整規(guī)范的道德顯露出固有的缺陷,因而道德調(diào)整的領(lǐng)域大大縮小,‘而法律的適用領(lǐng)域不斷增加,并逐漸波及社會(huì)生活的各個(gè)方面,因而現(xiàn)在社會(huì)稱之為法治社會(huì)。西方古希臘時(shí)期亞里士多德就提出“良法”的兩個(gè)標(biāo)準(zhǔn)。至此,法律與道德的關(guān)系問(wèn)題就進(jìn)入了理論與實(shí)踐的雙重考量區(qū)域。道德與法律作為兩種最主要的社會(huì)調(diào)整規(guī)范方式,具有十分豐富的法哲學(xué)和倫理學(xué)的內(nèi)涵。一些道德規(guī)范被法律所吸收,一些法律蘊(yùn)含著道德意蘊(yùn)。固法律應(yīng)與道德保持一致。 本文從法治的動(dòng)態(tài)層面分析法治實(shí)踐過(guò)程中的道德基礎(chǔ)。第一部分論述立法過(guò)程中的道德基礎(chǔ)。立法是法治實(shí)踐過(guò)程的初始環(huán)節(jié),必須有道德的審度。本文首先解析立法權(quán)來(lái)源的道德理論基礎(chǔ),然后分析倫理道德在立法過(guò)程中的基礎(chǔ)性作用。第二部分論述執(zhí)法過(guò)程中的道德基礎(chǔ)。公正執(zhí)法是社會(huì)主義法治的重要過(guò)程,執(zhí)法必須要有道德限度,政府誠(chéng)信是執(zhí)法公正的保障。所以本文從政府的誠(chéng)信程度著手來(lái)論述執(zhí)法的成效,然后試論執(zhí)法主體的倫理責(zé)任。第三部分論述司法過(guò)程中的道德基礎(chǔ)。懲治罪惡,扶持正義是司法倫理的基本原則,司法機(jī)關(guān)要充分利用道德評(píng)價(jià)手段使法治效果更具影響力。第四部分論述守法過(guò)程中的道德基礎(chǔ)。遵紀(jì)守法是每個(gè)公民的最基本義務(wù),社會(huì)公德是遵紀(jì)守法的基礎(chǔ),也是遵紀(jì)守法的表現(xiàn)。
[Abstract]:The development of human society's adjustment and regulation system has gone through a period of mixed religion, ethics, custom and law. With the development of modernization, morality and law are gradually separated, each has its relatively independent field. In modern society, compared with the law, the morality, which was the main regulation of the society, has revealed its inherent defects, thus the field of moral adjustment has been greatly reduced, and the application of the law has been increasing. And gradually affected all aspects of social life, so the society is now called the rule of law society. Aristotle put forward two standards of "good law" in ancient Greece. So far, the relationship between law and morality has entered the dual consideration area of theory and practice. As two main ways of social adjustment, morality and law have rich connotations of philosophy of law and ethics. Some moral norms are absorbed by the law, and some laws contain moral implications. Solid law should be consistent with morality. This paper analyzes the moral basis of the practice of the rule of law from the dynamic level of the rule of law. The first part discusses the moral basis in the legislative process. Legislation is the initial process of the practice of rule of law, must have moral evaluation. This paper first analyzes the theoretical basis of the source of legislative power, and then analyzes the basic role of ethics in the legislative process. The second part discusses the moral basis in the process of law enforcement. Just law enforcement is an important process of socialist rule of law, which must have a moral limit, and government honesty is the guarantee of law enforcement justice. Therefore, this paper discusses the effectiveness of law enforcement from the level of government honesty, and then discusses the ethical responsibility of law enforcement subjects. The third part discusses the moral basis in the judicial process. Punishing crime and supporting justice are the basic principles of judicial ethics. Judicial organs should make full use of the means of moral evaluation to make the effect of rule of law more influential. The fourth part discusses the moral basis in the process of abiding by the law. Abiding by law is the most basic duty of every citizen, and social morality is the basis and performance of abiding by law.
