【摘要】： 社會(huì)主義和諧社會(huì)是一個(gè)理性、有序和人本的社會(huì)。構(gòu)建和諧社會(huì)不僅要求堅(jiān)持以經(jīng)濟(jì)建設(shè)為中心不動(dòng)搖,增強(qiáng)和諧社會(huì)的物質(zhì)基礎(chǔ),同時(shí)在此基礎(chǔ)上還要大力加強(qiáng)政治文明建設(shè)和先進(jìn)文化建設(shè)。而無(wú)論是物質(zhì)文明還是政治文明都離不開(kāi)法制的發(fā)展和完善,離不開(kāi)法律文化對(duì)法治精神的弘揚(yáng)。公民權(quán)利的尊重與保護(hù)、公共權(quán)力的合理分配和有效監(jiān)督與制約,無(wú)不需要一個(gè)載體,而這個(gè)有效的載體就是構(gòu)建與和諧社會(huì)相適宜的法律文化。 本文從分析和諧社會(huì)與法律文化的重大關(guān)系入手,進(jìn)而指出現(xiàn)實(shí)生活中法律文化的缺失現(xiàn)狀,最后提出要構(gòu)建與和諧社會(huì)相適宜的法律文化即：社會(huì)主義先進(jìn)法律文化。社會(huì)主義先進(jìn)法律文化是在批判繼承傳統(tǒng)法律文化和吸收西方法律文化的優(yōu)秀成果中孕育,在中國(guó)特色社會(huì)主義的環(huán)境中成長(zhǎng)、壯大。社會(huì)主義先進(jìn)法律文化正確揭示公權(quán)力的實(shí)質(zhì),遏制公權(quán)力的異化；體現(xiàn)權(quán)利本位的時(shí)代精神；彰顯以人為本、公平正義的崇高理念。社會(huì)主義先進(jìn)法律文化是構(gòu)建和諧社會(huì)進(jìn)程中不可或缺的保駕護(hù)航之利劍。
[Abstract]:Socialist harmonious society is a rational, orderly and humanistic society. Building a harmonious society requires not only insisting on the economic construction as the center and strengthening the material foundation of the harmonious society, but also strengthening the construction of political civilization and advanced culture. Both material civilization and political civilization can not be separated from the development and perfection of the legal system and the promotion of the spirit of the rule of law by legal culture. Respect and protection of civil rights, rational distribution of public power and effective supervision and restriction, all need a carrier, and this effective carrier is to construct the legal culture suitable for harmonious society. This article starts with the analysis of the important relationship between the harmonious society and the legal culture, then points out the present situation of the lack of the legal culture in the real life, and finally puts forward that the legal culture suitable for the harmonious society should be constructed, that is, the socialist advanced legal culture. The advanced legal culture of socialism is conceived in criticizing and inheriting the traditional legal culture and absorbing the outstanding achievements of western legal culture, and growing and expanding in the environment of socialism with Chinese characteristics. The socialist advanced legal culture correctly reveals the essence of public power, restrains the alienation of public power, embodies the spirit of the era of rights-oriented, and highlights the lofty concept of people-oriented, fairness and justice. The socialist advanced legal culture is an indispensable sword in the process of building a harmonious society.
