【摘要】：蘇聯(lián)憲法學(xué)說(shuō)對(duì)中國(guó)憲法學(xué)說(shuō)的影響集中體現(xiàn)在20世紀(jì)50年代,但其影響過(guò)程前可追溯至20世紀(jì)20年代以降,后可延續(xù)至20世紀(jì)80、90年代。其影響的方式體現(xiàn)為翻譯出版蘇聯(lián)憲法的教材、著作和論文,蘇聯(lián)法學(xué)專家直接開(kāi)設(shè)"蘇維埃國(guó)家法"課程介紹蘇聯(lián)憲法理論;影響的內(nèi)容主要表現(xiàn)在憲法概念、憲法作用、憲法本質(zhì)、憲法與法制和法治的關(guān)系、人民權(quán)利與公民權(quán)利、憲法學(xué)體系等方面;影響的結(jié)果可歸結(jié)為憲法學(xué)研究"階級(jí)斗爭(zhēng)范式"的形成、以國(guó)家學(xué)說(shuō)為核心的憲法學(xué)體系建構(gòu)以及輕視憲法基礎(chǔ)理論的研究。
[Abstract]:The influence of Soviet constitutional theory on Chinese constitutional doctrine was concentrated in the 1950s, but its influence can be traced back to the 1920s and then extended to the 1980s and 1990s. The way of its influence is to translate and publish the teaching materials, works and papers of the Soviet Constitution, and the Soviet legal experts directly introduce the Soviet Constitution Theory by offering the course of "Soviet State Law", the content of which is mainly manifested in the concept of the Constitution, the role of the Constitution, The essence of constitution, the relationship between constitution, legal system and rule of law, the rights of people and citizens, the system of constitutional law and so on, the result of which can be attributed to the formation of "class struggle paradigm" in the study of constitutional law, The construction of constitutional law system with the core of state doctrine and the research of despising the basic theory of constitution.
